“A HISTORY”


The Philippines most southern island, Mindanao, has been experiencing continuous trouble caused by several secessionist group more particularly the Moro rebellion. The government considered this situation as serious and has been sending the armed forces to topple down this uprising. In the forefront of this armed conflict are elements of the then Philippine Constabulary (PC) which was always assigned in the provinces and interior areas to fight these insurgency problems. This Constabulary men, mostly in their early twenties were left to conduct combat operations and occasional civic & community assistance in luring back the citizen to side with the government.

The Philippine Constabulary, usually assign teams composed of eleven to fourteen soldiers in one front outpost called detachment to curved down, if not eradicate rebellion and brought back normalcy in these areas. The Cotabato province, well known of its Moro rebellion was always the most dangerous area of assignment for these Constabulary soldiers. The PC men as they were known, learned to survived using protracted warfare schemes, fighting the enemy using two fronts, through guns and through friendly community relations. However, the PC men also adopted schemes for themselves to survived the regular harassment inflicted to them by the enemy. Buddy system were applied protecting each others’ back at all times. This was when the soldiers organization came into life. The “Anito” which was later on called the “DIABLO Squad” and much later known to be the “Guardians”.

It was April of 1976 that the original eleven (11) members of the Anito Group was formed in a PC Detachment at Sitio Kidama, Parang, Maguindanao where then Constable 1st Class Leborio Jangao, Jr, PC, organized it for the purpose of simple camaraderie and the concept of protecting each other. These Philippine Constabulary soldiers were all assigned in one detachment under the leadership of CIC Jangao. Being stationed in one place, made it easy to organized. The eleven Anito members including CIC Jangao were, CIC Leborio “Abraham” Janagao, Jr who conferred himself as Godfather (GF) and with a pseudonym “Abraham”, CIC Ernesto “ Alas” P. Torres, Jr, CIC Arthur “ Percival” Camins, CIC Nolito “Halcon” Alabarin, , CIC Alex “Zeus” Bonifacio, CIC Cesar “ Alvaro” Arevalo, CIC Romeo “Brix” Gonzales, CIC Alvin “Domino” S. Salvacion, CIC Margarito “Azul” Ejansantos, CIC Jaime “Jerico” Bargamento, , and CIC Hamid “Krisanto” S. Singa. CIC Leborio Jangao, Jr conceived the idea of forming them with his personal concept of “Walang Iwanan” during encounter in the actual combat against the enemies in the battlefield, underlying its principles of Brotherhood, Unity, Solidarity and Oneness”. The Anito Group, which was sometimes branded as the “Diablo” gained recognition as fierce fighting soldiers. Having established the image of brave and gutsy PC men, the group gained respect and sometimes fear from the enemies. In the later part of 1976, the group was transferred in Barangay Baliton, Glan, formerly part of South Cotabato province and now under Sarangani province to conduct a peacekeeping campaign in said area. In their brief stay in Barangay Baliton, they gained recognition and support from the constituents for their exemplary performance. Since then, there was no expansion of membership, as the group was reassigned to the different PC Provincial Commands and PC Strike Battalion in Mindanao

The life of a soldier is considered unpredictable. Part of their duty was to obey the order of the higher authorities. As soldiers, they were ready to be transferred and or assigned anywhere in the country. So, in 1979, Leborio “ Abraham” Jangao, Jr was reassigned again in Lanao Norte PC Provincial Command located in Iligan City. This time he resumed his plan of expanding the membership of the group prompting him to convince his fellow soldiers to join his group and recruited them to be his immediate disciples. Having perhaps, the concept of the “twelve tribes” of Israel, he formed the “Diablo Squad- Dirty Dozen” to start an organization. He then formally named it as the DIABLO SQUAD, and the members of the twelve Tribes were named the DIRTY DOZEN. All of the members were soldiers mostly belonging to the Philippine Constabulary except of the three (3) members, one belonging to the Philippine Army, Nephtali Real, numbered 1-11, the other one belongs to the Police force, Alberto M. Tinoy numbered 1-12 and Elpidio Seletaria who was from the Philippine Navy and was numbered 1-13. There were actually fourteen (14) Dozen are:

The thirteen (13) members of the Dirty Dozen were given the assignment to recruit twelve members each as their recruitment quota and grant them the mark of their own as a continuation of their numbers. The concept was to continue and expand the DIABLO SQUAD through the thirteen members of the Dirty Dozen identifying their lineage. This was actually taken from the idea of the Twelve Tribes of Israel and Abraham was considered the father of all nations. Leborio Jangao adopted the pseudonym Abraham and considered himself as Godfather (GF), the eventual father of all DIABLO squad members.

The original concept of the Diablo Squad was for the membership of rank and file men of the AFP. Expansion should only be for the Non-Commissioned officer and below. This was a brotherhood of ordinary soldiers whose experience prompt them to bond themselves and help each other. The Diablo Squad started to spread and grew reaching other AFP units. The name Diablo became a legendary recall, catching the interest of commissioned Officer and the AFP higher command. This made CIC Leborio “GF Abraham” Jangao uneasy being the target of the ire of the AFP chain of command.

At this instance, he met the then 1Lt Gil K. Taojo, Jr, the Officer In Charge of the Regional Security Unit (Intelligence Unit) stationed in Iligan City. Leborio “GF Abraham” Jangao discussed with Lt Taojo the existence of the DIABLO SQUAD fraternity. Being classmates in the PC Basic Course in Parang, Maguindanao in 1973, it was easy for them to understand each other. Lt Taojo believed on the purpose of CIC Jangao in forming the Diablo Squad. Leborio Jangao suggested to Lt Taojo to help him (Jangao) with the Diablo Squad. This was suggested because Leborio Jangao felt that he could no longer stand the pressures of the other commissioned officers and most especially the higher AFP Command. Leborio Jangao was just an ordinary soldier at that time, and the members of the Diablo Squad were all ordinary soldiers. Leborio Jangao felt that they need some commissioned officers as their cloak for the Diablo to avoid harassment and evade the ire of the officers. It was not really Lt Taojo who was the special officer to be approached. Leborio Jangao may have approached someone else. However, because Lt Taojo was available and they were once together in their lives as soldiers, Leborio Jangao felt more easy to approached Lt Taojo. 1LT Gil K. Taojo, Jr agreed to join the Diablo Squad and be marked bearing the pseudonym SGF LAPULAPU, and numbered 01, as the first commissioned Officer who joined the DIABLO SQUAD fraternity in 1980. Captain Anastacio Labitad,PA, who was then the commanding officer of the Composite Military Police battalion also joined the Diablo Squad. Considering that he was more senior in rank than LT Gil K. Taojo, Jr. he should have been marked with the number ahead than the later. However, since LT Taojo already bore the marked of the first commissioned officer, the number of Cpt Labitad was “00” with the pseudonym “ Patton”. Later on Police Lieutenant Lilia Buala joined them and marked as “02” with the pseudonym “ Amazona”

The entry of 1LT Gil K. Taojo, Jr to the Diablo Squad was not a welcome call for the members of the Dirty Dozen. They were opposed for his membership considering that the concept of the Diablo Squad was for the rank and file members of the AFP only. Besides, they were very sure that being a commissioned officer and with the rank higher than all of them, they will be dominated and his authority in the AFP ranking will surely prevail, giving them no freedom and equal opportunity to participate in the decision making of the Diablo Squad. However, CIC Leborio Jangao convince the members of the Dirty Dozen that the entry of 1LT Taojo was a big help for the organization in consideration of his present rank and influence. The present situation of the Diablo Squad is not stable during that time. The AFP high command was questioning already the existence of the Diablo Squad, and with the membership of Commissioned officers, this will at least give them protection.

The entry of 1LT Gil Taojo, Jr created a stir in the existence of other members. His rank in the AFP was definitely carried on to the organization. The once equal treatment of members, suddenly turned into an officers command ruling. 1LT Taojo, Capt Labitad and PLT Buala started making decisions for the Diablo Squad. CIC Jangao was only consulted considering that he was the one who originally organized the Diablo Squad, but decisions of the commissioned officers always prevailed. This prompted the other members of the Dirty Dozen to “stay low”. The others continued to support CIC Jangao but lukewarm to the leadership of 1LT Taojo. Later on , only the names of 1LT Gil “Lapulapu” Taojo, Jr, Cpt Anastacio “Patton” Labitad, Lt Lilia “ Amazona” Buala and Sgt Leborio “Abraham” Jangao were known to the Diablo Squad. The Dirty Dozen was sometimes forgotten. Their existence and lineage was not propagated and supported by the Commissioned officers and there was even an attempt to disband it for the reason that the name “Dirty Dozen” was no good to hear.

The members of the Diablo squad continued to spread all over Mindanao. The ordinary members who belong to the rank and file became interested in joining the organization. Positive responses were at hand from the members of the Armed Forces of the Philippines. The Diablo Squad help minimized if not eradicate in-fighting in the AFP. The internal competition were lessen. Soldiers from the battle front who usually cause trouble with other commands were controlled. The Diablo brotherhood prevails and instead, you can notice soldiers assisting each other despite of the fact that they belong to different commands.
More and more commissioned officer joined the Diablo squad. Seeing its potential force, those who may have some personal reasons opted to be part of the group.
The continuous recruitment and growth of the Diablo Squad caused more worries in the AFP higher leadership. The entry of rebellious soldiers and critical to the AFP leadership during that time made the existence of the Diablo Squad more vulnerable to suspicion of internal uprising. The AFP having an unstable flow of command was critical to any organization within the AFP. Most of the officers of the AFP high command, capitalized on the bad connotation the name “DIABLO” brought to the AFP. The Diablo Squad continued to experienced harassment from commissioned officers as instructed by the higher ups. The recruitment of Lt Taojo and other commissioned officers of the AFP never resulted to stabilizing the organization in as much as pressures is concerned. The thought of the stoppage of the harassment and pressures to the Diablo Squad the moment Lt Taojo will be recruited, never materialized. Despite of the presence of Lt Taojo, Captain Labitad , Lt Buala and other officers, the higher command of the AFP still continued to pressure the organizers to disband the Diablo Squad.

The continued pressures to disband the Diablo Squad prompted its officers to adopt another title with a more subtle and meaningful name. In the later part of 1981, the DIABLO SQUAD was renamed into DIABLO SQUAD THE CRIME BUSTERS. A Constitution and By-laws of the Diablo Squads the Crime Busters was drafted and later on adopted by the membership. The name Diablo became an acronym giving every letter of it a very meaningful translation. Every letter of the acronym DIABLO was given a meaning which when define shall state: D – stands for Dauntless, I – Ingenuous, A – Advocator, B – Banner, L – Liberty and O – Oneness . In Tagalog version means: Mga Matapang at Matapat na Tagappagtanggol ng Watawat, Kalayaan at Pagkakaisa ng lahing Pilipino. Finally, an assembly of all available members was called at Empire Village, Pala-o, Iligan City on November 16, 1981 and the delegates ratified, approved and adopted the Constitution and By-laws of the Diablo Squads the Crime Busters. The first MAGIC GROUP members were all lawyers in Iligan City known as the MAGIC FIVE namely: Atty Ulysses Lagcao, Atty Angel Mencias, Atty Roberto Albulario, Atty Nicomedes Palangan and Atty Melvin Salise Every letter of the Acronym MAGIC represents:. M - stands for Magistrate, A – Advocator, G – Grievances, I – Impotent and C – Citizens which means: Mga Mahistradong Tagapagtanggol ng mga Naaapi at Walang Lakas na Mamamayan.

In that same year of 1981, the first National Convention of the DIABLO SQUADS, CRIME BUSTERS was held in Iligan Institute of Technology, Iligan City with more or less five hundred (500) members attended. During this occasion, Lt Gil “ Lapulapu” Taojo, Jr, PC had been officially conferred the title Founder Supreme Godfather (FSGF), Capt Anastacio “ Patton” Labitad, PA as Supreme Godfather Consultant (SGFC), and Sgt Leborio “ Abraham” Jangao, Jr, PC and Founder Godfather. In addition, Sgt Malih “Mohammad” Maong PC was commissioned to organize the pioneering DSCB in Zamboanga City and nearby provinces. The Commissioned officers prevailed over the leadership of the Diablo Squad. As expected by the original members of the Dirty Dozen, the ranks in the AFP will always rule in the organization. The original Dirty Dozen was never given honor neither recognition.

The widespread recruitment of the Diablo Squad within the ranks in the AFP continued. The AFP high command felt it was already growing and becoming a threat to the Armed Forces. The situation was far worse because it was coupled with the news that an impending Coup de E’tat was in the offing. During that time, the grip of the then President Marcos was dwindling. More and more military officers were disgruntled and the AFP leadership who was at that time loyal to the President was disturbed with instability. The existence of the Diablo Squad was not an exemption. Some officers of the AFP higher command suspected that the Diablo squad may be in cahoots with the coup plotters. Besides, some members of the RAM is too identified with the Diablo Squad. This resulted to persecution against DSCB members in Mindanao. The Diablo Squad leadership received many complaints coming from DSCB members in different places in Mindanao informing them on how they were persecuted by its respective commanders. In the middle part of 1983, The leadership of the Diablo squad in the persons of LAPULAPU, ABRAHAM and PATTON met inside the GHQ canteen and talked about the reported persecution of DSCB members in Mindanao. It was discussed that the Diablo Squad should be identified as a civilian organization and not a military fraternity. This can only be done if a non military person should be the one to lead the organization.

According to the accounts of Lt Gil “ SGF Lapulapu” Taojo, Jr. , he volunteered to resign from the Armed Forces and lead the organization to ease the pressure and help the members who are in the AFP service. However, there were some information though conflicting, claimed that the expiration of the enlistment of Lt Gil “ SGF Lapulapu” Taojo, Jr converted him to civilian and that it gave him the chance to lead the Diablo Squad as a civilian leader. You may have noticed that even after Lt Gil “ SGF Lapulapu” Taojo, Jr. conversion to civilian, the members of the Diablo Squad continued to experienced harassment from the higher Military command. So, their claim and analogy never came into reality and never ease the pressures of the AFP higher command.

The first assembly of the DSCB at Marcos Sports Center, Cagayan de Oro City was held in 1983. This was already attended by many members coming from the civilian recruits. Said occasion was highlighted by the presence of the then Cpt. Anastacio “ Patton” Labitad, PA and the then MSgt Leborio “FGF Abraham” Jangao, Jr as resource speakers attended by more or less one hundred members coming from the different provinces of Region X.

It was very ironic that despite of the increasing number of members of the Diablo Squad and its existence for almost eight years, the organization was not able to secure legal personality. Meaning, despite the leadership of Commissioned officers of the AFP and the support of many members, the Diablo Squad was not legally registered in any government entity either in the Securities and Exchange Commission or the Cooperative Development Authority from 1976 up to 1983. Accounts states that it was able to secure a Constitution and By Laws as early as 1980 and even drafted another one in 1982. It spread like wildfire for those years. It suffered persecution according to some but none of the officers worked for its legality. Persecution should have been minimized if the Diablo squad was legally registered. Having a legal personality will always have all the reason to fight back legally and get the needed justice.

It was only in 1984 that concerned members from Zamboanga City worked for the registration of the Diablo Squad (CB) Brotherhood Association, Incorporated securing SEC registration and finally registered it under registration number 0119564 dated March 12, 1984. These were, Edwin H. Vargas, Leovigildo Lanto, Mamerto Romero, Jesus Mabalot, Jose Saplan, Jefrey Hortador, Reuben Roa, Jesus Paul, Jose Regino, Ceferino Bernardo, Elias Enriquez, Salvador Olarte, Jose Manglikmot, Antonio Espiritu and Roman Tigas. The registration gave the Diablo Squad equal rights as all other association. This should have been a cloak of legality and can already be an arm to fight the persecution claimed by majority of the rank and file soldiers who are members of the organization.

This was however, disowned by the Commissioned officers leading the Diablo squad headed by Lt. Gil “ Lapulapu” K. Taojo, Jr. The reason of disowning this group and branding them as unscrupulous was not known to other members. Instead of thanking these very people of giving legitimacy to the Diablo Squad by registering it the SEC, they were condemned. In that same year, the group of Lt. Gil “ Lapulapu” K.Taojo, Jr, caused the disbandment of the Diablo Squad by instructing the then Sgt. Leborio “ Abraham” Jangao to sign a disbandment letter and give it to the AFP higher command. Sgt. Leborio “ Abraham” Jangao was enticed to disband his own organization, the organization he conceptualized and formed, the brotherhood that catapulted these commissioned officers to limelight and made them famous.

The group of Diablo Squad members headed by Lt Gil “Lapulapu” Taojo, Jr., immediately replaced the Diablo Squad Crime Busters with the Guardians Brotherhood Incorporated (GBI). Leborio “ Abraham” Jangao, Jr, the father of the Diablo Squad was no longer in the list of incorporators. The GBI was registered in December 10, 1984 with SEC registration No. 123899. Leborio “ Abraham” Jangao, Jr was again enticed to write a letter to the SEC requesting the office to cancel the SEC registration of the Diablo Squad (CB) Brotherhood Association, Inc. However, the request was not given due course because Leborio “ Abraham” Jangao, Jr was not part of the Registered Diablo Squad in as much as legality was concerned. The replacement of the Diablo Squad Crime Buster into Guardians brotherhood Incorporated was a decision of few Diablo Squad officers. The general membership was not consulted nor informed of the proposal. They were all left behind and taken for granted.

The reason known to the general membership of the Diablo Squad why it was replaced with the Guardians Brotherhood Incorporated (GBI) was because of the pressures made by the higher hierarchy of the AFP. However, the reason given was in conflict of the earlier pronouncements of the leaders of the organization. The reason of recruiting Commissioned officers within the Diablo Squad was to ease pressures from the AFP leadership. Leborio “ Abraham” Jangao recruited Lt. Gil “Lapulapu” Taojo, Jr for him to lead the organization and ease whatever pressures from the other commissioned officers. But this never happened. Despite the entry of Lt. Taojo, the harassment and persecution was still widely experienced by the members. Then, the name was again change to Diablo squad the Crime Busters, to again ease the pressures and ire of the AFP Leadership. But still, the harassments escalated. The alleged sacrificed of Lt. Gil “Lapulapu” Lapulapu Taojo by allegedly resigning and converting to civilian in order again to curved the harassment inflicted to the Military men was never realized. Then again, Changing further the name from Diablo Squad Crime Buster to Guardians Brotherhood Incorporated never resulted to stability of the organization. It continued to experienced harassment and persecution.

Not known to everyone, while the Guardians Brotherhood Incorporated (GBI) registered in December 10, 1984 under SEC registration No. 123899, was conceived and known to be the replacement of the Diablo Squad Crime Busters, The original Diablo Squad (CB) Brotherhood Association, Incorporated registered in March 12, 1984 under SEC registration No. 0119564, continued to exist as legitimate organization. This was only revoked on August 11, 2003 for routine reasons of failure to submit annual reports. This means that, the GBI now became a faction of the original Diablo Squad and not the original as claimed by majority of its members. This is perhaps the reason why, majority of the original members of the Diablo Squad are still in-active or have lost their enthusiasm to function actively within the GBI. This side of the event was never known to the original members of the Diablo squad turned Guardians. They were made to believed that the Diablo Squad no longer exist. This has resulted to the exodus of the Diablo Squad members to the GBI. The DIABLO Squad died because of “pseudo information”. The father of the Diablo Squad collaborated with the Lt Taojo and the rest of the GBI Incorporators to cause the downfall of the very organization they once proudly represents. They don’t even want to carry its name at this time having claimed that this carries a bad connotation and image. The untimely Death of the Diablo Squad suddenly came in 1984 . The instant birth of the GBI in the expense of the Diablo members brought to life in that same year.

The Guardians Brotherhood Incorporated (GBI) expanded rapidly. In the absence of fast communication system and having controlled the communication of the military camps, many Diablo members believed on the legitimacy of the GBI being the replacement of the Diablo Squad. Nobody within the original Diablo members was able to dispute the claim. Besides, the organization was already controlled by new recruits having occupied key positions in the military and the magic group. The original Dirty Dozen were still bearing the ranks lower than the commissioned officer. Further, Leborio “ Abraham” Jangao, the perceived father of the Dirty Dozen sided with these officers for apparent reasons. He never realized that he was being set aside and eventually be forgotten. The recruitment was then focus on the Guardians, forgetting the once strong, united and the original Diablo squad. There was also a rapid expansion of the MAGIC GROUP throughout the Philippines. The word GUARDIANS, an acronym was better known than the DIABLO. Emphasizing the meaning of every letter of the word GUARDIANS which means: G- Gentlemen, U – United, A –Associates, R – Race, D – Dauntless, I –Ingenuous, A – Advocator, N – Nation, S- Society

It means that Guardians are Gentlemen, United Associates of the Filipino Race, Dauntless and Ingenuous Advocator of the Filipino Nation and Society. The original GBI organization was administered by a Cpt. Anastacio “ FSGFC Patton, PA as President, Lt.Gil “FSGF Lapulapu” Taojo, Jr., PC (INACT) as Vice Pres. and Sgt. Leborio “FGF Abraham” Jangao, (PC) as Adviser). Leborio “ “Abraham” Jangao, Jr became merely an adviser. The original organizer and who conceptualized the founding of the Diablo Squad was no longer within the decision makers’ group. The leadership was occupied by Officers of the AFP. The original concept of the organization to be the brotherhood of ordinary soldiers vanished. The organization of the Diablo was then became the turf of the officers of the AFP. Cpt. Anastacio “FSGFC Patton” Labitad, PA directed that DSCB members shall have the “GUARDIANS’ tattoo on the lateral extremity of the left upper arm just below the shoulder and the additional marking of “GM” (Guardians Mindanao), “GV” (Guardians Visayas), and “GL” (Guardians Luzon) shall be tattooed on the superior area in-between the thumb and the point finger of the left hand and the “GBI Rank/Branch of Service” on the right hand. New members are tattooed with the traditional “GUARDIANS” mark on the right upper arm and the additional markings on the left and right hand respectively.

The events that succeeded after Sgt. Leborio “ Abraham” Jangao recruited Lt Gil “ Lapulapu” Taojo, Jr can be equated to the life of Andres Bonifacio, the father of the Katipunan. Andress Bonifacio sacrificed a lot in organizing the KKK for the sake of the ordinary Filipino people. When Emilio Aguinaldo, an “ilustrado” who belong to the “elite” Filipino, became a member by way of recruitment, he lord it all in the KKK and eventually causing the death of Andres Bonifacio. Emilio Aguinaldo became more famous than Andres Bonifacio. He even became the President of the Republic of the Philippines, while Andres Bonifacio, the father of the KKK, was killed, upon the order of Emilio Aguindaldo during the Philippine revolution.

In 1985, Guardians Foundation Centre Incorporated (GCFI) was created as a foundation of the GBI organization. The main tasked of the GCFI was to generate financial/logistical support for the GBI organization particularly those GBI members who are in distress or in extreme necessity financially. The leaders and members of the GBI were surprised of the swept turning of event when GCFI recruited prospective members for membership which is contrary to the very purpose of its existence. GCFI became a legitimate separate Guardians organization registered under the SEC. This became a faction of the GBI.

The first Regional Assembly of GBI Region XI Chapter held at Venees Hotel, Matina., Davao City on August 17, 1986. There were more or less six hundred members who attended the said first Regional Assembly. The main agenda of the said assembly were the Information and Education about the objectives of the GBI organization. The regional election was also held.

Persecution against the Diablo, now GBI members by some Officers became worst. Some unscrupulous field commanders in Mindanao particularly in the Army Commands strictly and severely enforced the directive of the Higher Command that non – erasures of GBI markings shall mean non – reenlistment into the Regular Force AFP. What was at stake during that time was the very survival of their families because their means of livelihood were so threatened. Such occurrence was so hurting for them to bear but still they managed to reiterate further their unwavering loyalty deep inside their hearts to the GBI organization. But the members continued to survived.


Sensing the immediate needs of the Organic’s (Uniformed men/women in the AFP/PNP) protection, GBI Region XI Chapter hierarchy called for a Regional Convention sometime in 1989 purposely to circumvent the said unabated worsening situation. GBI Chapter in General Santos City hosted the said Regional Convention to promulgate innovative measures to amend some provisions of the original GBI Constitution and Bylaws. The focal point of the said amendment was centered on the conversion of the GBI organization from a military fraternity to a civilian –led organization known as Non—Government Organization (NGO) similar to some other civilian organizations. Unfortunately, the efforts of amending some of the obsolete provisions of the original Constitution and Bylaws of the GBI was not finished due to lack of material time and it was reset indefinitely until sometime in 1995 that the matter at issue was finally realized with the completion of the Constitution and Bylaws of the Guardians Brotherhood Region XI Chapter Incorporated. It was registered with the Securities and Exchange Commission on September 29, 1995 with SEC Registration DNO95-000521.

In 1999, The Guardians Brotherhood Region XI Chapter Incorporated particularly Davao City Chapter hosted the 1st National Convention for Guardians Unification held at Greenheights Hotel, Buhangin, Davao City on October 1 and 2, 1999. This was attended by more or less 400 delegates from the different Regions in Mindanao which includes Lt. Taojo, Leborio Jangao and Cpt. Labitad who were then conferred earlier as Triumvirate. Sen Gringo Honasan, Mayor Benjamin “BCG” de Guzman and Mayor Rodrigo “CM” Duterte also graced the occasion. The convention delegates were able to come up with a Constitution and Bylaws for Guardians Unification under the name Philippine Guardians Incorporated (PGI). In this particular occasion, Gregorio “SGF Goyong” Duremdes was promoted to the rank of Founder by the National Triumvirate in the presence of Sen Gregorio “Gringo” Honasan. Few days later, the said Constitution and Bylaws was hand carried by Dionisio “Fdr Moulder” Quieta to the office of Sen. Gringo Honasan for subsequent registration with the Securities and Exchange Commission. Unfortunately, the National Secretariat for Guardians Unification formed by Sen Gringo Honasan rejected the said Constitution and Bylaws.

Sen. Gregorio “SGF Gringo” Honasan, the Interim National Chairman for Guardians Unification called for another National Guardians Unification Convention. It was held at Videospecs Building, Roxas Blvrd, Pasay City on March 18 and 19, 2000. Every Region was allotted one voting delegate to tackle the Constitution and Bylaws for Guardians Unification. The delegates were able to come up with a New Constitution and By-laws under the name PHILIPPINE GUARDIANS BROTHERHOOD INC (PGBI) and subsequently registered with the Securities and Exchange Commission on June 26, 2000. Dionisio “ Fdr Moulder” Quieta joined Sen. Gregorio “Gringo” Honasan with the PGBI and became one of the Incorporators abandoning the Guardians Brotherhood Incorporated ( GBI). Lt. Gil “FSGF Lapulapu” Taojo, Jr, Cpt. Anastacio “ FSGF Patton” Labitad, Msgt Leborio “ FGFC Abraham” Jangao and the rest of the officers of the GBI campaigned for the adoption of the PGBI as the new unification name. However, after knowing of the salient provisions of the new PGBI Constitution and By-Laws, they made a one hundred eighty degree turn and rejected the PGBI. They found out further, that under the PGBI Constitution and Bylaws the role and functions of the Founders are just mere advisers only and cannot hold vital or key positions in the Administration of the PGBI.

The National GBI organization has suffered another blow after the creation of the PGI, the supposed unification group of the Guardians. The original plan of further changing the name from GBI to PGI purposely for unification was actually supported by the Triumvirate namely, Lt Gil “FSGF Lapulapu” Taojo, Jr., Cpt Anastacio “FSGFC Patton” Labitad and Msgt Leborio “FGFC Abraham” Jangao, Jr. It was only upon learning that the Two officers Lapulapu and Patton will have no major role and can no longer decide for the organization that they withdraw their support from the unification group. However, announcement were already made and majority of the GBI and Diablo members already joined the PGI which was actually registered as PGBI. Again, an exodus of GBI members flock the PGBI. This includes the Iligan City Diablo Squad –GBI Founding Chapter. The original Diablo Squad members were enticed to join the PGBI because they were told that this was the collective decision as a result of the National Convention attended by the Triumvirate. All of the members of the Founding chapter was set to join the PGBI except for Alberto “MF Phantom” Tinoy, a member of the original Diablo – Dirty Dozen was then in Saudi Arabia working.

After the expiration of the work contract of Alberto “ Phantom” Tinoy in Saudi, Arabia, he went home to Iligan City and was informed of the new development. However, he refused to join the PGBI and instead talked to the original Diablo squad to stay foot with GBI being their present group from the Diablo Squad. He lead the preparation of the position paper stating among others their stand to stay with GBI as it was believed to be the remaining remnant of the Diablo Squad. That earned another name for the founding chapter for their loyalty and steadfastness in times of confusion and urgency. Alberto “MF Phantom” Tinoy proved it again that being a member of the original Dirty Dozen, he cannot be cannot be swerved. Majority of the Dirty Dozen never joined the PGBI.

A regional assembly of GBI members in Region X area was held at Cagayan de Oro City on May 4, 2002. This was called by Cpt. Anastactio “FGSC Patton” Labitad was attended by members coming from the different Provinces and Cities under Region 10 areas. Lt. Gil “FSGF Lapulapu” Taojo, Jr and top leaders of Region XI Chapter were invited to attend the said assembly. It was in this particular occasion where Lt. Gil “FSGF Lapulapu” Taojo, Jr Jr and Cpt. Anastacio “ SGFC Patton” Labitad were officially installed as MASTER FOUNDERS by virtue of a resolution passed by the participants of the said assembly. Also taken up in the said assembly were the election of Interim Regional Officers as well as information drive on the concept of Federation as a system of governance of the GBI geared towards the establishment of a Federated Guardians Mindanao, Federated Guardians Visayas and Federated Guardians Luzon. The Guardians Brotherhood Region XI Chapter Incorporated hosted the 1st Mindanao Founders’ Summit at Maguindanao Hotel, Claro M Recto St., Davao City on May 26, 2002 with an inspiring theme: “PANAGHIUSANG HUGPONG GUARDIANS MINDANAO PINAAGI SA FEDERALISMO”. The GBI adopted the concept of Federalism. This Federal System of Governance was duly deliberated and subsequently voted upon overwhelmingly by the said participants (Founders). After a month, GUARDIANS BROTHERHOOD REGION X CHAPTER INCORPORATED was registered was finally with the Securities and Exchange Commission with SEC Reg H20002000255 on June 14, 2002.

The 2nd GBI National Convention was held in Elena Tower Inn, Tibanga, Iligan City on April 5, 2003. Indeed, it was a pilgrimage to the mecca of the Guardians World. Among the highlights of the said festivity were the celebration of the 23rd Anniversary of the GBI Founding Chapter of Iligan City, the adoption of New Bylaws of GBI and the promotion of Suprema Amazona Buala to the rank of Master Founder.

The 3rd GBI National Convention was held in San Abuyog, Leyte on April 29-30, 2005. Among the highlights of the said National Convention was promotions to National Founders of some deserving active Founders in the organization from Luzon, Visayas and Mindanao and the elections of new set of Officers in the National Chapter. In this year also that Guardians Brotherhood Region X111 Caraga Chapter Inc. was registered with the Securities and Exchange Commission IN Cagayan de Oro City adopting the Federal System of Government through the efforts and initiative of Felix “FRMG Ely” Datingaling.


In 2006, Lt. Gil “ MF Lapulapu” Taojo, Jr, called for the conduct of the unscheduled 4th National Convention and Special National Assembly. This was hastily conducted at Molave Hotel, Tagum City, Mindanao, Philippines on August 26, 2006. The affair was participated in by delegates coming from Luzon, Visayas and Mindanao, with attendance mostly coming from Davao area particularly from Davao Norte and Davao Oriental, the home province of Lt. Gil “ MF Lapulapu” Taojo, Jr. The calling of the unscheduled convention was an offshoot of the bickering between Lapulapu and the group of Lawyers who are members of the GBI Davao City. This was triggered by the insistence of Lapulapu for the implementations of his decisions and policies even if this was not in accordance with the GBI By Laws. He further claimed that he was cloth with “ Inherent Powers” as carried by being the first Supreme God Father of the organization. He was insisting that he is not covered with disciplinary rules and that the GBI Justice tribunal has no jurisdiction over him.

However, the GBI officers who are Lawyers argued that the GBI is an “organization of rules and not of Men” and therefore, nobody is exempted in the pursuit of order. Every member is subject to disciplinary schemes and is answerable to the members.

As a result, Lt. Gil “MF Lapulapu” Taojo, Jr was subjected to a trial by the GBI National Justice tribunal based on the complaint filed against him by several officers for several violations against the Constitution and By Laws. He was invited and summoned to defend himself but MF Lapulpau refused to recognized the tribunal. Lt. Gil “MF Lapulapu” Taojo, Jr was expelled from the GBI, the order was approved by the National President as recommended unanimously by the members of the Tribunal. Upon learning of this predicament, Lt. Gil “ MF Lapulapu” Taojo, Jr. commissioned Dante “ Offroad” Simangan to draft a Constitution and By Laws that will give MF Lapulapu immunity. After thorough review and study, an amendment to the GBI By Laws was introduced during the special Assembly giving the Triumvirate Power to replace and appoint officials from the national down to the local level of the GBI. A shift from the Presidential Form of Government into a Parliamentary Form of Government was also introduced in the amendments, whereby participants have unanimously voted for the ratification and approval of the new GBI Constitution and By-Laws adopting the Parliamentary Form of Government. In this new system of government, the new structure was properly arranged and at this point in time, the National Triumvirate was officially installed headed by Lt. Gil“MF “Lapulapu” Q Taojo, Jr declaring him as the new Prime Minister of the GBI Organization. It was followed by organization of Officers in the National level through appointment. The GBI however again suffered another division as some chapters and regions continue to follow the mandate of the elected officers under its National President, NF Awel Gana.

On December 9, 2006, the appointed Guardians Parliament installed Themistocles “ John Bull” Romeo was as a new member of the National Triumvirate in lieu of late Anastacio “MF Patton” Labitad who passed away on that same month. Themistocles Romeo was at the same time elevated to the rank of Master Founder (MF) from his rank as National Founder (NF)

On April 25-27, 2008, another National convention was held at Tumaga, Zamboanga City. This was attended by delegates coming from The Different Chapters and Regions all over the Country with participation of members coming from the overseas. Though the attendance was not really substantial, It further amended the Constitution and By Laws. The New By Laws followed the concept of Federalism giving more authority to the Provincial and City Federal Confederations of the GBI. The form of the Guardians government is now Parliamentary – Federal. The Constitution and By Laws was drafted by Dante “NF Offroad” M. Simangan with the advise of Gil” MF Lapulapu” K.Taojo, Jr. The position of a Supreme Master Founder (SMF) was given to MF Lapulapu.

The GBI under the auspices of Lt. Gil “Lapulapu” Taojo, Jr continue to experience leadership challenge. Since Lt Taojo assumed leadership of the organization starting from the Diablo up to the GBI, breaking away of members and the continues resignations and creations of another factions became already a routine. Judging from history, and as a result of the research conducted by the new members of the Guardians, the center of the ire and division was focus on Lt Taojo himself. His brand of leadership is not applicable to the very independent minded, principled and democratic members. His autocratic style of management coupled with his dependency with the organization became an obstacle to the growth of the organization.

The first “blunder” of Leborio “Abraham” Jangao by allowing the Commissioned Officers of the AFP to join the organization which was supposed to be an organization of ordinary soldiers without clear policies as to the leadership issue resulted to the unstable leadership of the organization until today. History tells us that after the entry of Lt Taojo, the leadership immediately was handled by him and the supposed pioneering members, the Dirty Dozen were no longer given the chance to lead. The very purpose of Leborio Jangao to ease the ire of the AFP higher commend upon the entry of Lt. Taojo was never realized. The membership of Lt. Taojo became an opening for other Commissioned officers to be accepted as members of the Diablo Squad and eventually turned the organization as their mass base for loyalty and support. Though, positively, these lessen and even eradicated the in-fighting between soldiers in the different AFP major services.

The name of the organization was change several times in order to make it appear to be non- offensive and to avoid the ire of the AFP higher command. However, the purpose was never realized. The perception of the leadership of the organization failed and it even further drag the organization into the pit of interest giving more concerns with the AFP higher command. The refusal of other original Diablo members to adopt the new name from Diablo members to Guardians was a clear manifestation of lukewarm respect to the leadership of the organization. Some were caught un aware of the sudden change of name. Other members never knew of a consultative assembly for them to be heard of their opinion before a major decision should have been approved and implemented. Lt. Taojo and the rest of the incorporators may have missed the theory of consultative leadership considering that the organization was at that time already a mixture of civilian and military members. The creation and eventual separation of the GCFI which was supposed to be the financial arm of the organization was a clear picture of dissatisfaction. Lt. Taojo as a leader was not able to hold on the officers and members to stay with the GBI.

Another blow to the leadership was the creation of the PGI, a unification group that was conceptualized, agreed, and eventually implemented by majority of the active members of the GBI and later collapsed as a unifying group but was continued with a separate leadership structure. The hierarchy of the GBI was not able to hold on again to the organization and many of its members opted to join the group organized by Sen. Gregorio “Gringo” Honasan. The PGBI of Sen. Honasan even grew bigger than the GBI and many of the original Diablo Squad members found it more convincing joining them than the GBI. This is again a clear view of leadership dissatisfaction. Leborio “Abraham” Jangao, the father of the Diablo Squad was eventually expelled by the GBI under the leadership of Lapulapu. Brotherhood was forgotten. After what Leborio “Abraham” Jangao did to Lapulapu, giving him all the support and recognition, relinquishing to Lapulapu his chances to be the top most person of the organization, he ( Lapulapu) was not able to at least protect him( Abraham) and help him in times of needs.

At the very least, even in the ranks of the GBI leadership, breaking away continue to exist. The group of Fdr Libra Go, broke away and formed their own group which was using the same SEC registration of the GBI. The group call themselves GMB. The cause of the broke up was still leadership questions, and Lt Taojo was not able to solve it. Later on, he’s pronouncement even further aggravated it and caused more trouble. Succeeding breakaways continued and creation of factions became an ordinary routine for the Guardians. The GBI under the leadership of Lapulapu became the producer of dissatisfied members that was seen as those that organized their own Guardians Factions. The continues refusal of Lt. Gil “ SMF Lapulapu” Taojo, Jr to relinquished his leadership to other much qualified and effective members caused the organization a lot of problems and created more divisions. His desire for a perpetual stay in the higher hierarchy of the organization was seen as the cause of all these problems now the organization was experiencing.

Sensing all these things and events, the newly recruited members who now became officers started to conduct research within the organization. Many of them being, highly educated and occupying high and sensitive positions in their field of profession were not satisfied of the explanation given to them of the failure of the organization. Most of these new members even “dug” in more, on the history of the Diablo and asked many pioneering members about the true beginning of the organization. They started to question some decisions of the Triumvirate and even argued with precession and reasons. As a result, the new members were either relieved, suspended or even expelled by Lapulapu through his Acting Prime Minister for no apparent reasons or sometimes fabricated accusations.

In May 22, 2010, the Diablo Squad - Dirty Dozen together with the original Diablo members and the new GBI members called for Special Assembly in Iligan City, the home of the Diablo Squad and the Guardians. This was supposedly intended only for Mindanao members. However, concerned members from Cebu and Luzon choosed to attend the assembly for them to know the real issues. Despite of the SMS messages by MF Johnbull and SMF Lapulapu declaring the assembly illegal and ordering the members not to attend, the assembly was able to gather 205 participants with all the regions in Mindanao represented. The organizers were not expecting an overwhelming response from the members and such attendance was already more than enough to decide on pertinent matters.

The attendee of the special assembly decided to submit amendment to the GBI Constitution and By laws pointing among others the scrapping of the immunity claus of the Triumvirate to give equal rights and opportunity with other ordinary members. It also proposed the autonomy of the three (3) major islands of the Philippines and the overseas. It also introduced transparent collections and the full implementation of important provisions of the Constitution and By Laws which is being rigged by Johnbull and Lapulapu.

The proposal was submitted immediately to the National headquarters and to the Guardians Parliament through Johnbull and Lapulapu. However, this was not given due course and was not included in the agenda when Lapulapu and Johnbull called for a Parliament session and Conference. Instead, those national officers who attended the assembly was even further relieved from their duties and complaints were filled with fabricated accusations. This has turned the supposed solution to the problem a reason for expulsion.

With this development, the founding chapter together with other national officers and the Dirty Dozen meet again in June 9, 2010 and finally decided to withdraws their support from Lapulapu and form a separate group which will no longer recognize the leadership of the Triumvirate and expose their acts which were not in accordance with the doctrine, history and principle of the original Diablo Squad. The members of the Dirty Dozen came out into the open and voiced out their disappointments. Many of the original Diablo Squad air their feelings and related their story.

Actually, this has started several years ago until the old and reliable members of the Diablo Squad can no longer held their disappointments. The dirty Dozen, whom for several years just held their breath and stayed in the sideways finally stood up and said it all. They sympathized with this new members and supported their cause. They corrected the history and related the true events that brought the organization into the limelight. The Diablo Squad – Dirty Dozen feel that it was already the time for them to speak up and assert their existence and faced the reality.

They are now finally leading the organization by asserting the argument that the word DIABLO was and is never bad after all. The sacrifices and suffering they experienced in the fast for pioneering the organization cannot be bought with anything but a sensible recognition and respect of the name. In order for the organization to succeed, the Dirty Dozen proposed for a more democratic organization. The true history should be written and exposed, and the leadership should be open to those who are qualified, capable and able. Personal interest should never be part of the agenda, and those found guilty shall be meted the equivalent penalty. Everyone, which means officer or member, shall be treated equally as this was the vision of the organization when it was first organized in 1980. There shall not exist any person who may be treated as above other members. The concept of the Diablo Squad of helping each other shall remain as the highest value within the Diablo-Guardians family. The original Diablo squad- Dirty Dozen proposed for the organization of the DIABLO-GUARDIANS MAINTREAM INCORPORATED, a TRUE DECENDANTS OF THE DIABLO SQUAD, to be known to everyone with all the ORIGINAL DIABLO MEMBERS to affiliate and renew their membership. This will bring together the OLD DIABLO SQUAD members and the NEW GUARDIANS members into one solid, renewed and true brotherhood under one organization.

Finally, the DIABLO SQUAD should be resurrected in order for the original members of the Diablo Squad to be given importance as those that sacrificed in the early years of the organization. As proudly as we should be today, we should also be proud of the name DIABLO, the beginning of all these things. MABUHAY ANG DIABLO SQUAD! MABUHAY ANG TUNAY NA GUARDIANS!

PREAMBLE

We, GUARDIANS, formerly known to be the DIABLO members, believing on the tenets of democratic principle, increasing the level of our hope and faith for the divine providence; inculcating in our minds the belief on fraternal doctrine of brotherhood; offering justice, peace, discipline, service and equality to our fellowmen, do ordain and promulgate this Constitution and By-laws.


ARTICLE I
NAME AND DOMICILE


Section 1. The Association shall be known as the MAINSTREAM GUARDIANS BROTHERHOOD INCORPORATED ( GBI – MAINSTREAM ), SEC Registration No. CN201026952 dated AUG 16, 2010, Formerly the DIABLO SQUADS (CB) BROTHERHOOD ASSN., INC which was registered under SEC Registration 0119564 dated March 12, 1984

Section 2. The GBI MAINSTREAM National Headquarters shall be located in Iligan City, Mindanao, Philippines;

Section 3. The members shall be called DIABLO - GUARDIANS;

Section 4 The name DIABLO- GUARDIANS connotes respect as it means, “ The Dauntless and Ingenuous Gentlemen of the Filipino Race, United under One Banner and Advocator of the Nation and Society” translated to Filipino language as “ Mga Magigiting at Matatapat na mga Ginoo ng Lahing Pilipino, Tagapagtanggol sa ilalim ng nagkakaisang Bansa at Lipunan”

Section 5. The word DIABLO - GUARDIANS as broken down into letters corresponds its representation as to the following: D- Dauntless, I – Ingenuous, A – Advocator, B – Banner, L- Liberty, and O- Oneness; G- Gentlemen, U – United, A- Associates, R- Race, D – Dauntless, I – Ingenuous, A – Advocator, N- Nation, S- Society.

Section 6. The Motto of the association is “ Brotherhood for Equality, Peace and Prosperity” and Adopts the colors White, Red, Yellow, and Blue as its national color
ARTICLE II
OFFICIAL SEAL

Section 1 The Mainstream Guardians adopts a five (5) color seal maintaining the DIABLO logo situated at the center of the seal. In the inner most portion is the hand clasp that symbolizes true bonding of members believing in love and friendship, the highest value among all people of the land. It also bears the four (4) stars that represents the main Federal confederation, Luzon, Visayas, Mindanao & Overseas. It has a feature of a sword ( Pilipino “Kampilan”) which symbolizes might & power along with the scale of justice for just acts and equality to all members of the organization. Its triangular form symbolizes strength and stability, coupled with principled desire to serve the humanity with humility. The laurel leaves symbolizes peace and prosperity of all members. The inner part is bonded with double circles that shows strength of camaraderie.

The color yellow, represents light and direction, while blue represents peace and nationalism. The color red is for love and bravery as a value of noble tradition. The six (6) guiding principle encircling the totality of the inner logo controls all members and lessen its pride, where, humbleness and love prevails.

The inner logo is protected by a shield of authority with the inscriptions of the bold Guardians name in the top most. The GBI Mainstream is located below the inscription and the phrase “ United we stand” which is the original slogan if the Diablo Squad is written above the inner logo.

The thirteen yellow stars just below the inner logo represents the original members of the Diablo Squad – Dirty Dozen who started the organization in the Military establishment. This also symbolizes as the strong base of the organization as its footstall, being situated in the bottom and appearing to be holding the inner logo.


ARTICLE III
DECLARATION OF PRINCIPLES

Section 1. The Association believes that the human being is composed of the Physical body, soul and spirit. The nourishment of these three elements is the priority concern of the organization, thus, the Fraternal Association believes in God as supernatural being and the need of our wholehearted submission to Him is necessary.

Section 2. The association is a non-stock, non profit, non-sectarian and an apolitical organization but strongly respect and adheres to the Constitution of the Republic of the Philippines and all other laws that governs in the democratic government of the Republic promulgated by the duly constituted authorities. We support government officials who are just, honest and God fearing and those who are members of the Mainstream Guardians Brotherhood Incorporated. We believe that whoever is occupying the government position is installed by God and thus, we fully support them collectively, except those who are challenged by bona-fide members of the organization who are equally capable, qualified, God fearing, honest and just of whose support shall be given and offered.




Section 3 The association is a non government, a civic and a service organization crafted into one, with strong beliefs of a Fraternal spirit. This firmly believed that the word “ Brotherhood” shall be put into action. Unity and development among and between members are of first priority in order to effectively implement its program and introduced effectively sustainable development within the community


Section 4 DIABLO - GUARDIANS VISION:

“To become a Model of all voluntary Association which promotes responsible citizenship, advocating Nationalism, unselfish service to the community, reaching out to other people using the spirit of fraternal tradition, which will eventually be a development partner of our Government.”


Section 5 GUARDIANS MISSION:

“The Mission of the Association shall be for its members to:

• To Spearhead the voluntary service to their respective neighborhood.
• To be responsive to the needs of the community, offering voluntary assistance to the needy.
• To inculcate in the minds of the Diablo - Guardians that through our brotherhood, we can lift up the spirit of concern, honesty, trust and truthfulness in the entire country.


ARTICLE IV
PURPOSES AND OBJECTIVES

Section 1 To believe that there is God and He has dominion over all things thus, we have a responsible stewardship over material things, and the wisdom of truthfulness adhering for the respect to authorities, selfless love and service for people and the respect for women and children.

Section 2 To foster harmonious relationship, unity and cooperation between and among members for mutual support and benefits and to undertake developmental activities for the general welfare of the members of the association as a whole;

Section 3 To extend immediate financial, legal and other assistance to the members of the association but encourage self reliance in the entire membership.


ARTICLE V
MEMBERSHIP

Section 1. The Applicants for membership must posses the following qualifications:

a. Filipino Citizen
b. Generally a law abiding citizen
c. No criminal record
d. Male or female, with a minimum age of twenty one (21) years old in the time of Application
e. Must be in good health
f. Must be gainfully employed or self employed ( farmer, businessman, pensioner) with enough income to sustain the needs of the family for civilian applicants or active members of the Armed Forces of the Philippines, Philippine National Police, Bureau of Jail Management and Penology, Bureau of Fire Protection, Philippine Maritime Police, and Philippine Coast Guard.
g. Must posses the Educational qualifications of a College Level. A high school graduate may be accepted provided he/she is equipped with special skills needed by the Organization. The Federal legislative body may however change the educational qualifications of the applicants which shall be based on their economic and community position status. The general basis of which is still focus on the goal of the association recruiting “assets” to the association and not “liabilities”.

Section 1.a Foreign Nationals may be qualified to apply for membership provided that they are resident of the Philippines, married to a Filipino citizen , and or having legitimate business in the country, or, employed in any legitimate company operating in the Philippines holding the Philippine Visa categories as working, or permanent resident. Visiting foreign nationals holding a tourist visa are not qualified.

Section 1.b The Process of recruitment will always depend on the situation of the community and the behavior of the population. The Federal Confederations shall determine the process and set the standard of recruitment for implementation.

Section 2. Rights of Members:

a. To enjoy all the benefits and privileges of an Active member such as follows:

1. Eligible to an elective or appointive office of the Association;
2. participate in the deliberation/ meetings of the Association
3. To avail of all the facilities of the Association;
4. To examine all the records or books of the Association during business hours;
5. To a lifetime membership, unless withdrawn or expelled for a cause;
6. To recommend applicants for membership per recruitment schedule;

Section 3. A member shall have the following duties and responsibilities:

a. To obey and comply with the By-Laws, rules and regulations that may be promulgated by the Association from time to time;
b. To pay membership dues and other assessments of the Association;
c. To file a written complaint before the chapter/fraternal officer concerned in case of infractions and violations:
d. Such other duties and responsibilities the Association as promulgated from time to time.

Section 4. Markings, Classification and Color Designation of Members. The markings refers to equivalent Rank conferment.

a. General Markings ( As tradition rooted from the Diablo)

MG - Represent the Magic Group (Mint Green);
R - Represent the Philippine National Police (Red);
B - Represent the Philippine Army (Blue);
W - Represent the Philippine Navy (White);
V - Represent the Philippine Air Force (Violet);
G - Represent the Bureau of Fire Protection (Gold);
M - Represent the Bureau of Jail Management and Penology
( Maroon);
C - Represent the Philippine Coast Guard (Cream)

b. Special Markings

MF - Represents the Master Founder
NF - Represents the National Founder
F - Represents the Founder
SGF/SGM - Represents the Supremo (Supreme Godfather) /Suprema (Supreme Godmother);
RMG - Represents the Ranking Magic Group; and
GF/GM - Represents the Godfather / Godmother.

c. Correspondingly marked by a tattoo on the superior area in-between the thumb and point finger of the right hand with letters particularly described above.

d. The “Guardians” mark including the pseudonym, year of admission and the letter “M” which stands for Mindanao, for those accepted in Mindanao, “V” which stands for Visayas, for those accepted from Visayas, and “L” which stand for Luzon, for those accepted from Luzon, and “O” for those who joined overseas, are made permanently by appropriate tattoos on the lateral extremity of the upper right arm just below the shoulder.

Below the Guardians mark is the permanent number of the membership lineage from the twelve (12) original members of the “Diablo – Dirty Dozen”. This is the proof that the member originated from the Dirty Dozen or the twelve Tribes of the Diablo Squad. Numbering from the original 1-1,1-2,1-3,1-4,1-5,1-6,1-7,1-8,1-9,1-10,1-11 & 1-12, every father of the tribe will bear twelve (12) sons/daughters which will follow the numbering in accordance with the lineage. The second generation will have three (3) number –sets, 1-1-1, or 1-12-1. the third generation will get only the first generation number; 12- 8 – 3G -2 or 1-6 -4G-3

e. The letter markings “GM” stands for Guardians Mindanao, “GV” which stand for Guardians Visayas, and “GL” which stand for Guardians Luzon, and “GO” for Guardians Overseas, are tattooed on the superior, in-between the thumb and the point finger of the left hand to easily identify areas of membership.

f. ‘MG” Represents the rank of the newly accepted GBI member coming from the Civilian Sector and classified herein as member of the Magic Group or the corresponding identifying mark where the new member came from the organic group of branch of service.

Section 5. Conferment of Rank Promotion ( Not Position ) to Bona fide members according to its category and classification:

a. Master Founder (MF) is a rank promotion conferred to a member of the Association originated from the rank of National Founder who have exhibited outstanding performance to the organization. A national Founder who have stayed active for a minimum of five years and has gained the respect of the membership of the entire organization. He/She shall be considered honorable, prestigious and respectable without blemish and shall be voted upon by the entire membership of the Guardians Parliament and approved by the Council of Elders.

b. National Founder (NF) is a rank promotion conferred to a member of the association originated from the rank of Founder. The Number of National Founders shall be based on the total number of registered membership within the Federal Confederation Jurisdiction. The percentage for promotions to National Founder (NF) shall be determined by the Guardians Parliament. The Rank shall only be conferred upon those deserving Founders in terms of education, active services, payment of all dues with respectable achievement not only in the Mainstream Guardians Brotherhood Incorporated but including the community that he resides.

c. Founder ( F) is a rank promotion conferred to a member of the association originated from the rank of Supreme Godfather/Supreme Godmother (SG/FSGM), Godfather/Godmother (GF/GM), and Ranking Magic Group ( RMG) who had been a member of good standing for at least five (5) years in the organization. Further, The candidate for promotion shall be an active member of an active chartered chapter, meaning a chapter who complied with all the financial and documentary requirements as required by the National Office of the GBI

The number of Founders in the chapter shall be based on the number of active members in the chapter were he/she is registered. The Founder shall take exclusive charge of indoctrination rites.

Promotion to Founder however, will always depend upon achievement and contribution to the success of the organization and his attitude towards his members and the association in general;

d. Supreme Godfather (SGF)/supreme Godmother (SGM) is the rank conferred to a Commissioned Officer of the Armed Forces of the Philippines, Philippine National Police, Bureau of Fire Protection, Bureau of Jail Management and Penology, Philippine Coast Guard, Philippine Maritime Police, National Bureau of Prisons and Reservist. Retirees from the rank and file level who obtain the lowest rank of a commission Officer during retirement from his/her long tedious time of sacrifices in the government service shall be given credit or meritorious promotion of Supreme Godfather (SGF)/Supreme Godmother (SGM);

e. Ranking Magic Group (RMG) is a rank promotion conferred to a civilian member who is a professional and/or respected leaders of the community having rendered exemplary services coming from the rank of Magic Group (MG) whose promotion is equivalent to Godmother/Godfather or Supreme Godfather/Supreme Godmother (SGF/SGM);


f. The word “MAGIC” is an acronym which stands for:

M – Magistrate
A – Advocator
G – Grievances
I – Identified
C – Citizens

Which when translated into Filipino will mean “MGA MAHISTRADON MAGTATANGGOL NG MGA INAAPI AT NANGANGAILANGANG MGA KABABAYAN”

g. Godfather (GF) / godmother (GM) is composed of GBI senior members coming from the AFP/PNP/BFP/BJMP/PCG having the rank of Guardians who may have outstanding achievement as his contribution to the success of the organization.

h. Guardians (GDN) - represents the newly accepted GBI members coming from the AFP/PNP/BFP/BJMP/PCG and Reservist who is classified herein as members of the organic group.


Section 6. In case of change of status pursuant section 5 and 6 hereof, the affected member shall be marked with appropriate tattoo, in line with the original mark for all promotions for Founders which shall be on top of the original mark that will reflect his status, subject to another screening and testing procedure.

Section 7. Acceptance and Absorption of Members/applicants - No member/applicant from another Municipal and district Chapter shall be transferred, absorbed or accepted to another Municipal/District Chapter without clearance duly signed by his/her former Municipal/District Founder and Municipal President certifying his her good moral standing in his or her losing chapter.

Section 8. Members of other factions who shall voluntarily apply for reconciliation shall be screened as to the qualification standard. If found qualified, his/her application for reconciliation together with the Resolution of the Chapter Council and the endorsement of the Chapter President with the recommending approval of the Chapter Fraternal Commission shall be submitted the Prime minister through channel for approval. After which, a ceremony for reconciliation shall be conducted by a National Founder assigned in the area.

Section 09. Promotion of members – The Municipal/District President/Founder through Council Resolution shall make recommendations for promotions for the rank of RMG, SGF, GF & Founders (F) through channel, any deserving members for approval. The Council of Elders through the appropriate Bodies shall conduct interview to insure that those recommended for promotions are qualified for such rank. The Council may delegate its authority to lower bodies in cases of fast facilitation depending the urgency of the promotion. If found in order, the other requirements shall be complied with and the ceremony corresponding to the promotions shall be held and conducted.

In cases of promotions for the rank of National Founders (NF), only the Council of Elders may have the authority to determine the promotion after recommendation of the Prime Minister and upon consultation of the Fraternal Commission of the Chapter where the member belongs.

Promotion to the rank of Master Founder shall only be done if deemed necessary as determined by the unanimous decision of the Council of Elders as recommended by the unanimous vote of the Parliament which recommendation was duly certified by the Prime Minister. Promotion for the rank of Master Founder (MF) shall only be done during the National Assembly which is scheduled once every two (2) years.

For those to be promoted to the rank of RMG,GF and SGF, a designated official with the rank of Founder may conduct the appropriate ceremony.

Article VI
GOVERNMENT

Section 1 The Controlling Government set up of the Mainstream Guardians Brotherhood Incorporated shall be composed of the following subdivisions:

1. Council of Elders
2. Central Government
3. Federal Confederations
4. Federal Provinces/Cities
5. District/Municipal chapters
6. Barangay Chapters

Section 2. The Mainstream Guardians Brotherhood Incorporated shall at all times uphold the legitimacy of the elected and appointed officers of the organization as mandated in this Constitution & By-laws.

Section 4 The Mainstream Guardians Brotherhood Incorporated shall be governed and operate as a democratic government following the Federal – Parliamentary Form but with strong recognition and respect to the pioneers of the organization particularly the original Diablo Squad - Dirty Dozen.

ARTICLE VII
THE COUNCIL OF ELDERS

Section 1 The Council of Elders shall be the highest deciding body occupied by the Eight (8) elected members from the 14 Pioneering Members of the DIABLO Organization, called the Dirty Dozen, whose effort and voluntarism made the organization propagate and served as encouragement to unite and established the spirit of brotherhood among the members of the Armed Forces and the civilian group. The eight (8) members of the Council of Elders whose minimum rank is National Founder (NF) shall be elected by the delegates of the National Assembly.

Section 2 The Council of Elders shall serve the organization with utmost care and respect with the tradition, believing in the tenets of democracy, implementing properly the provisions embodied in the Constitution and By Laws. Their term of office shall be for the period of Four (4) years and shall submit to another election by the delegates during the annual National Assembly. For the purpose of the first election, the first Four (4) highest winners receiving the 4 highest number of votes shall serve for four (4) years and the second four (4) receiving the second highest number of votes will serve for two (2) years. Thereafter, four (4) members of the Council will expire every two years thus, election for the four (4) expiry members shall take place to serve for a four (4) year term.

Section 2 A In case the Dirty Dozen will no longer be existing, their quota of another twelve (12) members for every one (1) member of the original dirty dozen whose minimum rank is National Founder (NF), shall be considered qualified as replacement which shall still go through the process of selection as mandated in Section 1 of this Article. In case all of those belonging to the original Dirty Dozen and their quota is exhausted, other National Founders (NF) shall be qualified provided that the most senior in terms of membership and length of stay shall be given the preference and priority.

Section 3 The Council of Elders shall be the National Diplomatic Body and Adviser- consultant to the Central Government of the Mainstream Guardians Brotherhood Incorporated with authority to govern in case the Central Government loss its moral authority to lead and govern the organization.

Section 4 The Council of Elders shall have the authority to dissolve the Guardians Parliament or declare the Position of the Prime minister, Its deputies and other members of the Guardians Cabinet vacant when it deem necessary and for the exigency of the organization and appoint new members until a new election which shall be scheduled within three (3) months is called and or may assume the positions of the Prime Minister in cases of emergency situation until the election of a new parliament is called.

Section 5 The Positions of the Council of Elders shall be as follows:

One (1) - Chief Elder
One (1) - Deputy Chief Elder
One (1) - Secretary General

The election of the officers of the Council of Elders shall be done from among themselves right after the election of the members of the Council.
The position of the Chief Elder and the Deputy shall be offered first to the Council member whose rank is Master Founder( MF).

Section 6 The Council of Elders shall be in-charge of promotions for all ranks and shall review all applications for promotions submitted by the Federal Confederations. The Chief Elder shall approve all recommendations considered qualified by the Council of Elders except those that are explicitly explained in this Constitution & By Laws. Conferment shall be administered by the Master Founders assisted by the officers of the Council of Elders.


ARTICLE VIII
CENTRAL GOVERNMENT

Section 1 There shall be a Central Government of the organization who shall be considered as the National Controlling Body.

Section 2 The Central Government shall be headed by the Elected Prime Minister assisted by his Deputy and the Cabinet as the Executive Department, the Elected Parliament serving as the Legislative Department which is the National Policy making body, and the National Fraternal Commission serving as the Judiciary. Together with this Departments is the Guardians Doctrinal Commission (GDC).




Section 3 The duties of the Officers of the Executive Department:

Section 3-A THE PRIME MINISTER

1. The Prime minister shall be the head of the Central government of the Mainstream Guardians Brotherhood Incorporated who shall be elected by the official delegates of the national Assembly from among the Active National Founders as nominated by the general membership.

2. Responsibilities of the Prime Minister:

a. He is the Chief Executive of the Association.
b. Represents the Association in all social function
c. Make appointments of all appointive national positions of the national Association except those under the appointing authority of the other officers as stated in the Constitution and By Laws.
c. Approve all resolutions of the Parliament.
d. Approve and recommend all annual budget submitted by the
Different Ministries
e. Perform such other functions as mandated by the Constitution and By-Laws and promulgated by the Parliament.

Section 3-B THE SENIOR DEPUTY PRIME MINISTER:

1. The Senior Deputy Prime Minister with a minimum rank of National Founder (NF), shall be the next highest ranking official of the Central Government who shall be elected by the official delegates of the National Assembly.

2. The Senior Deputy Prime Minister Shall take the place of the Prime Minister incase of vacancy. In cases where the Senior Deputy Prime Minister position will permanently be vacant, the Guardians Parliament will elect a successor who will serve the unfinished term.

3. Responsibilities & Function of the Senior Deputy Prime Minister:


a. He shall perform the duties of the Prime Minister during absence or in capacity of the latter.
b. Shall be the Chief Administrative officer of the Office of the Prime Minister.
c. Perform all other functions as assigned to him by the Prime Minister

Section 4 The Prime Minister and the Senior Deputy Prime Ministers shall hold office for a period of two (2) years subject to reelections.

Section 5 The Prime Minister shall be assisted by the Guardians Cabinet ( GC) in the implementation of policies of the organization.

Section 6 The Guardians Cabinet shall be composed of the following Ministries, namely: Minister of Finance, Minister of Audit, Minister of Information, Minister of Judiciary, Minister of Membership and Promotions and Minister of Allied Services who shall be elected by the official delegates of the National Assembly.


Section 5 They will hold office for a period of two (2) years subject to reelections.

Section 6 Duties of the Officers of the Guardians Cabinet:

A. Minister of Finance:

1. He/She shall be the custodian of all properties and funds of the National Organization.
2. He/She shall keep the financial records as well as inventory of properties of the entire organization including all its financial transaction.
1. He/She shall sign and countersign by the National Prime Minister all disbursements of funds and other releases which shall be duly audited by the Minister of Audit.
2. He/she shall submit duly audited financial Reports to the Guardians Parliament on Quarterly basis and shall submit an annual Financial Statement.
3. He/She shall be responsible of his staff in the Ministry and shall coordinate with Federal Confederation on matters pertaining the finances of the organization.
4. He/She shall come from the territorial area of where the National Office is situated or at least within its proximity to make it easier to act on official business of the organization.

B. Minister of Audit

1. He/She shall be the National Auditor of the organization and as such, he/she shall conduct audit and monitor the funds of the organization from time to time.
2. He/She shall certify the Financial reports and countersign all vouchers for releases including the releases of properties before such release and disbursement shall be consummated.
3. He/She shall advise the Prime Minister on financial condition of the organization and may recommend cost saving measures.
4. He/She shall coordinated with the Federal Confederation on matters pertaining the control of the funds of the organization.
5. He/She may conduct surprised audit to the Federal Confederation and/or the Provincial/City Federal Government and the Chapter level if only to insure proper implementation of financial policies.

C. Minister of Information

1. He/She shall be the official spokesperson the National Organization and as such he/she shall at all times be properly informed of the situation, status and official activities of the organization.
2. He/She shall be responsible of the image building of the organization and shall at all times established a good community relationship.
3. He/She shall see to it that all Press or Media releases shall passed his/her office first before this can be release publicly.
4. He/She shall be responsible in the information dissemination in the organization shall have a close coordination with the Federal Confederations.





D. Minister of Judiciary

1. He/She shall be the National Arbiter in cases of conflicts in the interpretation of the Constitution and by Laws and all other National policies of the organization.
2. He/She shall deal with the administrative and disciplinary machinery of the organization.
3. He/She shall advise the Prime Minister in cases of decisions and the rules as promulgated by the Parliament before its application.
4. He/She shall serve as the Attorney General of the entire national Organization at such He/She shall recommend filing of appropriate legal action for any unauthorized, unlawful use of name, markings and logo of the GBI that would undermine or destroy the integrity and name of the organization committed by non-members or expelled members of the organization to the Prime Minister.

E. Minister of Membership and Promotions

1. He/She shall serve as National Director for Membership and Promotions and as such He/She shall see to it that all requirements for membership and promotions as submitted by inferior bodies are all in accordance with the requirements as embodied in the Constitution and By-Laws and all other membership and promotions policies promulgated by the Guardians Parliament.

2. He/She shall review all applications for membership and promotion before issuance of Certificates of membership and submission of the applications for promotions to the National Promotion Board.
3. He/She shall review all recommendations of the Federal Confederations in the granting of Charter to any Municipal or District before such shall be granted by the Prime Minister.
4. He/She shall advise the Prime Minister of the membership and promotion status of the entire National Organization.

F. Minister of Allied Services

1. He/She shall be in-charge of all other National activities not define in other Ministries and shall be responsible in the special programs of the Prime Minister.
2. He/She shall also be responsible of the security of the National Organization as well as the schedule of official travel of all officers of the Guardians National Officers.
3. The Election proceedings of all other inferior Bodies of the Guardians shall be his/her responsibility and shall see to it that these are all coordinated with the Prime Minister and the Guardians National Fraternal commission.
4. He/She shall be responsible in dealing with the re-integration of members and officers of other factions who signified their intention to join back or be integrated to the GBI Mainstream as recommended by the inferior Bodies, and forward the same to the Prime Minister for final processing.
5. Perform such other function as assigned to him/her by the Parliament or the Prime Minister from time to time.




g. The National Executive Director

1. The National Executive Director under the direction of the Guardians Parliament through the Prime Minister shall be the Chief Operating Officer of the entire organization and as such shall be responsible for the administration of the organizations program and plans and for making it effective in the entire organization in accordance with rules and regulations as may be promulgated by the organization through the Parliament from time to time.

He/She shall be appointed by the Prime Minister through the recommendation of the Guardians Parliament and shall be considered an employee of the National association. He/She shall come from the place and residing within the territorial area of the National Office location.

3 He/She shall be in-charge of the National Office and subject to the approval of the Guardians Parliament through the Prime Minister ,shall have the power to appoint and remove for cause any or all clerical employees of the National Office and to direct their work. As such He/She together with the clerical employees shall received due compensation whish shall be determined by the Guardians Parliament.

4. He/She shall Keep the Prime Minister and other officers of the National Headquarters inform on matters affecting the association; Coordinates the over-all programming of the Association.

5. He/She shall serve as the secretary of the Guardians Parliament, Secretary of the Cabinet and Secretary of the committees but without vote. As such., he/she shall be responsible of all the minutes of these Bodies and shall always keep all the officers informed of all the activities and program of the entire organization.

ARTICLE IX
The GUARDIANS DOCTRINAL COMMISSION

Section 1 There shall be a Guardians Doctrinal Commission which is directly under the office of the Council of Elders of whose members are appointed by the Chief Elder, Council of Elders.

This will served as the special department separate and distinct from the Guardians Cabinet whose major work is to help maintain fraternal standards of the entire GBI organization.

Section 2 The Commission shall be headed by the National Fraternal Director appointed by the Chief Elder, council of Elders

Section 3 The Guardians Doctrinal Commission shall formulate and promulgate principles, beliefs and dogma for the Fraternal Commissions, so that the general membership will be properly guided by the cardinal rules of brotherhood;

Section 5 The Commission shall be composed of the following Divisions each headed each by a Deputy National Director:

A. Membership and Development Division
B. National Supply Service Division

Section 6 Duties of the Officers of the Commission:

A. National Fraternal Director

1. He/She shall supervises the works of the Commission, as such, he/She shall preside over all meetings of the Commission.
2. He/She shall recommend to the Chief Elder all appointive positions in the Guardians Doctrinal Commission for appointment.

B. Deputy National Director for Membership Development Division

1. He/She shall be the overall in-charge of the training & seminars of the entire organization in coordination with the Minister of Membership & Promotions
2. He/She shall serve as the National Training Director
3. He/She shall see to it that members due for promotion shall have attended and completed the trainings and seminars required.
4. He/She shall perform all other functions assigned to him from time to time

C. Deputy National Director for National Supply Service Division

1. He/She shall be the overall in-charge of the supply service which includes official guardians uniform, Official T-Shirts, National Identification Cards, National Certificate of Membership, and other Official Guardians items.
2. He/She shall see to it that the organization shall follow the prescribed GBI paraphernalia
3. He/She shall make inventories, authorize suppliers, supervise distributions of supplies to the different chapters of the GBI
4. Perform all other functions as assigned to him from time to time


ARTICLE X
The GUADIANS PARLIAMENT


Section 1 The Guardians Parliament will be the highest Policy Making Body of the entire organization. As such, this shall formulate policies, pass laws and resolutions that will help propagate the Diablo - GBI in the entire territorial limits that will lead to successfully achieved its objectives. Such policies, laws and resolutions shall not be in conflict with those that is and was passed by the Federal Confederations.

Section 2 The Parliament shall scrutinize and approve the annual budget of the different Ministries submitted by the Prime Minister for the operation of the entire organization;

Section 3 The Parliament shall be composed of sixteen (16) regular members elected from among the National Founders (NF) within the regional jurisdiction and a maximum of ten (10) associate members who shall be coming from the overseas associates regions as created by the Parliament. In addition, the National Executive Director who shall be non – voting member shall sit as the Secretary of the Parliament.

Section 4 The Elected Regular & Associate Members shall served for a period of two (2) years with only one reelection. A candidate for the Regular & Associate member of the Parliament shall have the rank of a National Founder.

Section 6 The Guardians Parliament shall meet regularly with the frequency as decided by the body during the first regular session after its election and organization.

Section 7 The Guardians Parliament shall be presided by a Speaker who shall be elected from among the regular members of the Parliament.

Section 8 The Parliament shall have the following officers to be elected from among the members of the Parliament.

(1) Speaker ( Presiding officer )
(1) Floor Leader
(1) Floor Leader Pro-Tempore

Section 9 The Speaker Shall Appoint the Chairmen and the Members of the Different Committees of the Parliament. The identification of the committees shall be for the Parliament to decide.


ARTICLE XI
The GUARDIANS NATIONAL FRATERNAL COUNCIL (GNFC)


Section 1 The Guardians National Fraternal Council shall be the governing body for the quasi-judicial functions of the entire National organization. As such She shall serve as the Judiciary of the entire organization and shall be the National Grievance Council. It shall be referred to as the Judiciary.

Section 1-A The National Fraternal Council shall be the highest Judicial Body handling and deciding cases filed or elevated by lower Fraternal Commissions or directly filed by officers covered by the rules. The convened members of the National Fraternal Council who shall handle cases shall be called as National Justice Tribunal and shall be Presided by the Commissioner, Justice Tribunal.

Section 1-B Decisions of the National Justice tribunal shall cover all members and officers from the rank of MG, GDN up to Master Founders (MF) including those holding the position of Members up to Supreme Master Founder, including the officers and members of the Council of Elders

Section 2 The Guardians National Fraternal Council through its Election Tribunal, shall also serve as the National Nomination Committee in charge Diablo - Guardians National elections.





Section 3 The officers of the National Fraternal Council as appointed by the Prime Minister are as follows:

a. Chairman
b. Vice Chairman
c. Commissioner, Appointment Tribunal
d. Commissioner, Election Tribunal
e. Commissioner, Justice Tribunal
f. Commissioner, Security Tribunal
g. Commissioner, Audit Tribunal

Section 6. Duties and functions of the Officers of the Commission:

a. CHAIRMAN:

1. He is the Head of the Council.
2. Consults the Prime Minister on matters relative to the power of general supervision over the Council.
3. Exercise supervision and control over the various offices under the council.
4. Delegates authority to exercise any substantive or administrative matters
5. Perform such other functions as promulgated by the Guardians Parliament

b. VICE CHAIRMAN:

1. He/She shall assist the Chairman on any matters in the performance of his/her duties.
2. He/She shall performed other task that maybe assigned to him/her.

d. COMMISSIONER, APPOINTMENT TRIBUNAL:

1. He/She shall pass upon and review all cases that concerns appointments made according to regulations provided by the Association as passed through the Prime Minister in cases of complaints and questions.

2. He shall advise the Prime Minister through the Chairman of the National Fraternal Commission on all administrative questions affecting appointments extended by the Prime Minister;

3. He/She shall perform other duties as directed by the Chairman.

e. COMMISSIONER, ELECTION TRIBUNAL:

1. He/She shall have exclusive charge of the enforcement and administration of all regulations relative to the conduct of elections in the National Level.
2. He/Shall advise the Prime Minister through the Chairman of the National Fraternal Commission, on questions involving the right to vote, all administrative question affecting elections, including the determination of the number and location of polling places and the appointment of Election officers and other election officials and members;
3. He/She shall perform other duties as directed by the Chairman.

f. COMMISSIONER, JUSTICE TRIBUNAL:

1. He/She shall deal with the administrative and disciplinary machinery of the Association and shall served as the Presiding officer of the national Justice Tribunal when convened.
2. He/She shall have jurisdiction to review the decision, orders, and rulings of all Tribunals;
3. He/She shall advise such inferior fraternal bodies that may be established by the Association;
4. He/She has jurisdiction to review, revise, reverse, modify or affirm an appeal, final decisions of the inferior bodies submitted for review in:

a. All cases in which the constitutionality or validity of any resolution, circular, regulations, decision, or implementing order is in question;

b. All cases in which the jurisdiction of any inferior body is in issue;
c. All administrative cases in which the penalty imposed is expulsion from the Association;

g. COMMISSIONER, SECURITY TRIBUNAL:

1. He/She shall advise the Prime Minister through the Chairman of the National Fraternal Council matters pertaining the enforcement and administration of all regulations relative to the security of all officers and members of the Association;

2. He/She shall conduct investigation and recommend the prosecution of all offenses in violation of this By-Laws, and infractions of existing regulations;
3. He/She shall perform other duties as directed by the chairman.

h. COMMISSIONER, AUDIT TRIBUNAL

5. He/She shall advise the Prime Minister through the Chairman, National Fraternal Council matters pertaining the conduct of account examination, audit and settle all accounts pertaining to the revenues, receipts and expenditures of the association, or any of its subdivision, agencies, or any instrumentalities in cases of conflicts and as part of investigation of cases filed before the council that concerns finances of the association.
6. He/She may recommend measures necessary to correct the deficiencies of the audited chapters, agencies or units;
4. He/She shall perform all other functions as directed by the Chairman.

ARTICLE XII
The FEDERAL CONFEDERATIONS

Section 1 There shall be Guardians Federal Confederations for each of the three (3) main islands, The Guardians Federal Confederation of Luzon ( GFCL), Guardians Federal Confederations of the Visayas (GFCV) and the Guardians Federal Confederations of Mindanao (GFCM) and One (1) Guardians Federal Confederation Overseas (GFCO).

Section 2 The Guardians Federal Confederations shall be functioning distinctively and separately from each other, with full autonomy governing their respective areas. Each shall have their own departments and corresponding officers.

Section 3 The Federal Confederations shall have three major governing divisions with their corresponding officers namely:

Federal Deputy Executive Minister
Federal Minister of Finance
Federal Minister of Audit
Federal Minister of Information
Federal Minister of Justice
Federal Minister of Membership & Promotions
Federal Minister of Allied Services

2. The FEDERAL PARLIAMENT ( Legislative Department)

A. One Federal Member of the Parliament for every province and chartered City in the Philippines. For the overseas, there shall be one (1) Federal Member of the Parliament for every recognized overseas Chapter.

B. They will elect from among themselves the following Parliament officers:

Federal Speaker of the Parliament
Federal Floor Leader
Federal Floor Leader Pro-tempore

3. The FEDERAL FRATERNAL COMMISSION ( Federal Justice Tribunal)

Federal Chief Commissioner
Twelve (12) Federal Associate Commissioners
Section 4 The Federal Officers shall be elected by their respective official delegates attending in the National assembly as nominated from among the active National Founders of the respective territory of the confederation. They shall hold office for a period of two (2) years subject to reelection.

Section 5 Duties and Functions of the Officers of the Federal Confederations:

Section 5-A The Federal Confederation Executive department:


A. THE FEDERAL EXECUTIVE MINISTER

1. The Federal Executive Minister shall be the head of the respective Federal Confederations of the Mainstream Guardians Brotherhood Incorporated



2. Responsibilities of the Federal Executive Minister:

a. He is the Chief Executive of the Federal Confederation under his/her jurisdiction..
b. Represents the Association in all social function
c. Make appointments of all appointive Federal positions of the respective confederation except those under the appointing authority of the other officers as stated in the Constitution and By Laws.
e. Approve all resolutions of the Federal Parliament.
f. Approve and recommend all annual budget submitted by the
Different Federal Ministries
g. Perform such other functions as mandated by the Constitution and By-Laws and promulgated by the Federal Parliament.

Section 5-B THE FEDERAL DEPUTY EXECUTIVE MINISTER:

1. The Federal Deputy executive Minister with a minimum rank of National Founder (NF), shall be the next highest ranking official of the Federal Confederation.

2. The Federal Deputy Executive Minister Shall take the place of the Federal Executive Minister incase of vacancy. In cases where the Federal Deputy Executive Minister position will permanently be vacant, the Federal Confederation Parliament will elect a successor who will serve the unfinished term.

3. Responsibilities & Function of the Federal Deputy Executive Minister:

a. He shall perform the duties of the Executive Minister during absence or in capacity of the latter.
c. Shall be the Chief Administrative officer of the Office of the Executive Minister.
c. Perform all other functions as assigned to him by the Executive Minister

Section 5-C The Federal Executive Minister shall be assisted by his Cabinet who shall be composed of the following Federal Ministries, namely: Federal Minister of Finance, Federal Minister of Audit, Federal Minister of Information, Federal Minister of Justice, Federal Minister of Membership and Promotions and Federal Minister of Allied Services who shall be elected by the official delegates of the respective Confederations during the National Assembly.

Section 5-D Duties of the Officers of the Federal Confederation Cabinet:

A. Federal Minister of Finance:

1. He/She shall be the custodian of all properties and funds of the Federal Confederation.
3. He/She shall keep the financial records as well as inventory of properties of the entire federal confederation including all its financial transaction.
7. He/She shall sign and countersign by the Federal Executive Minister all disbursements of funds and other releases which shall be duly audited by the Federal Minister of Audit.
8. He/she shall submit duly audited financial Reports to the Federal Confederation Parliament on Quarterly basis and shall submit an annual Financial Statement.
9. He/She shall be responsible of his staff in the Federal Ministry and shall coordinate with central government and Provincial or City Federal Governments on matters pertaining the finances of the organization.
10. He/She shall come from the territorial area of where the Confederation Office is situated or at least within its proximity to make it easier to act on official business of the organization.

B. Federal Minister of Audit

6. He/She shall be the Federal Auditor of the Confederation, and as such, he/she shall conduct audit and monitor the funds of the confederation from time to time.
7. He/She shall certify the Financial reports and countersign all vouchers for releases including the releases of properties before such release and disbursement shall be consummated.
8. He/She shall advise the Federal Executive Minister on financial condition of the organization and may recommend cost saving measures.
9. He/She shall coordinated with the Federal Provinces and Cities on matters pertaining the control of the funds of the organization.
10. He/She may conduct surprised audit to the Provincial/City Federal Government and the Chapter level if only to insure proper implementation of financial policies.

C. Federal Minister of Information

5. He/She shall be the official spokesperson the Federal Confederation and as such he/she shall at all times be properly informed of the situation, status and official activities of the organization.
6. He/She shall be responsible of the image building of the organization and shall at all times established a good community relationship.
7. He/She shall see to it that all Press or Media releases shall passed his/her office first before this can be release publicly.
8. He/She shall be responsible in the information dissemination in the organization shall have a close coordination with the Federal provinces and Cities.


D. Federal Minister of Justice

5. He/She shall be the Confederation Arbiter in cases of conflicts in the interpretation of the Constitution and by Laws and all other policies of the organization.
6. He/She shall deal with the administrative and disciplinary machinery of the organization.
7. He/She shall advise the Federal Executive Minister in cases of decisions and the rules as promulgated by the Federal Parliament before its application.
8. He/She shall serve as the Attorney General of the entire Federal Confederation at such He/She shall recommend filing of appropriate legal action for any unauthorized, unlawful use of name, markings and logo of the GBI that would undermine or destroy the integrity and name of the organization committed by non-members or expelled members of the organization to the Prime Minister.

E. Federal Minister of Membership and Promotions

1. He/She shall serve as Federal Confederation Director for Membership and Promotions and as such He/She shall see to it that all requirements for membership and promotions as submitted by inferior bodies are all in accordance with the requirements as embodied in the Constitution and By-Laws and all other membership and promotions policies promulgated by the Federal Parliament. He/She Shall be the chairman of the Promotions to the rank of RMG/GF/SGF.

2. He/She shall review all applications for membership and promotion before issuance of Certificates of membership and submission of the applications for promotions to the Federal Promotion Board

3 .He/She shall review all recommendations of the Federal Provinces and Cities in the granting of Charter to any Municipal or District before such shall be granted by the Federal Executive Minister.

4 .He/She shall advise the Federal Executive Minister of the membership and promotion status of the entire Federal Confederation.

F. Federal Minister of Allied Services

6. He/She shall be in-charge of all other Confederation activities not define in other Federal Ministries and shall be responsible in the special programs of the Federal Executive Minister.
7. He/She shall be responsible in dealing with the re-integration of members and officers of other factions who signified their intention to join back or be integrated to the DIABLO- GBI Mainstream as recommended by the inferior Bodies, and forward the same to the Federal Executive Minister for final processing.
8. Perform such other function as assigned to him/her by t the Federal Executive Minister from time to time.


g. The Federal Director

1. The Federal Director under the direction of the Federal Executive Minister shall be the Chief Operating Officer of the confederation and as such shall be responsible for the administration of the organizations program and plans and for making it effective in the confederation in accordance with rules and regulations as may be promulgated by the organization through the Federal Parliament from time to time.

He/She shall be appointed by the Federal Executive Minister through the recommendation of the Federal Parliament and shall be considered an employee of the Federal Confederation. He/She shall come from the place and residing within the territorial area of the Confederation Office location.

3 He/She shall be in-charge of the Confederation Office and subject to the approval of the Federal Parliament through the Federal Executive Minister ,shall have the power to appoint and remove for cause any or all clerical employees of the confederation Office and to direct their work. As such He/She together with the clerical employees shall received due compensation whish shall be determined by the Federal Parliament.

4. He/She shall Keep the Federal Executive Minister and other officers of the Confederation office inform on matters affecting the association; Coordinates the over-all programming of the Association.

5. He/She shall serve as the secretary of the Federal Parliament, Secretary of the Cabinet and Secretary of the committees but without vote. As such., he/she shall be responsible of all the minutes of these Bodies and shall always keep all the officers informed of all the activities and program of the confederation organization.

Section 6 Duties and functions of The FEDERAL CONFEDERATIONS PARLIAMENT:


Section 6-A The Federal Confederations Parliament will be the highest Policy Making Body of the respective confederations. As such, this shall formulate policies, pass laws and resolutions that will help propagate the Diablo - GBI in the entire territorial limits that will lead to successfully achieved its objectives. Such policies, laws and resolutions shall not be in conflict with those that is and was passed by the National Parliament.

Section 6-B The Federal Parliament shall scrutinize and approve the annual budget of the different Federal Ministries submitted by the Federal Executive Minister for the operation of the entire organization;

Section 6-C The Federal Parliament shall be composed of Representatives of the different recognized Federal Provinces and Cities elected from among the National Founders (NF) within the area. In addition, the Federal Director who shall be non – voting member shall sit as the Secretary of the Parliament.

Section 6-D The Elected Regular Members shall served for a period of two (2) years with only one reelection. A candidate for the Regular member of the Federal Parliament shall have the rank of a National Founder.

Section 6-E The Federal Parliament shall meet regularly with the frequency as decided by the body during the first regular session after its election and organization.

Section 6-F The Federal Parliament shall be presided by a Speaker who shall be elected from among the regular members of the Parliament.

Section 6-G The Federal Parliament shall have the following officers to be elected from among the members of the Parliament.

(1) Federal Speaker ( Presiding officer )
(1) Federal Floor Leader
(1) Federal Floor Leader Pro-Tempore

Section 6-H The Speaker Shall Appoint the Chairmen and the Members of the Different Committees of the Parliament. The identification of the committees shall be for the Parliament to decide.

Section 7 Duties and Functions of the FEDERAL FRATERNAL COMMISSION
( The Federal Justice Tribunal)

Section 7-A The Federal Confederation Fraternal Commission shall be the governing body for the quasi-judicial functions of the entire Federal Confederation. As such She shall serve as the Judiciary of the entire Confederation and shall be the Federal Grievance Committee. It shall be referred to as the Federal Justice Tribunal.

Section 7-B The Commission shall be the highest Judicial Body handling and deciding cases filed or elevated by lower Fraternal Commissions or directly filed by officers covered by the rules.

Section 7-C Decisions of the Federal Fraternal Commission shall cover all members and officers from the rank of MG, GDN up to Master Founders (MF) including those holding the position of Members up to Supreme Master Founder and the officers and members of the Council of Elders whose membership is included in the territorial area of the Commission.

Section 7-D The Chief Federal Commissioner shall be the presiding officer of the Commission . The twelve (12) Associate Commissioner shall be assigned on cases filed or issues for decisions and comments. The assignment shall be done by among themselves.

ARTICLE XIII
PROVINCIAL OR CITY FEDERAL GOVERNMENT

Section 1 The Provincial or City Federal Government shall be composed of all Chapters situated or located in the area of jurisdiction of a Chartered City or Province as prescribed in the Local Government Division or specifically defined areas by the Federal Parliament.

Section 2 The Provincial of City Federal Government may adopt the original Chartered City or Provincial title as their identity or may adopt another Federal name but not omitting the original Charted City or provincial identity. The naming of the Federal Government shall be as follows:

Provincial or City Federal (Confederation) Government
(Name of Province of City)

Section 3 The Provincial or City Federal Government shall formulate policies for
the entire Province and or Chartered City and shall implement all policies promulgated by body and all rules and regulation including National and Confederation program for implementation.

The Provincial or City Federal Government shall have the sole control and supervision in its area of jurisdiction, shall have the power to en-act rules, resolutions, and or policies that deals with, but not limited to Finance & Funds, Membership, Program & activities and all other matters that may develop the organization within the Federal Area.

Section 4 The Provincial/City Federal Congress shall formulate policies not contrary to this By Laws and the Policies promulgated by the Federal Parliament or the National Parliament.


Section 5 The Provincial/City Federal Commission shall be composed of all Chapters under their area of jurisdiction and the officers shall be composed of Founders representing the different recognized and chartered Chapters in the said territorial area.

Section 6 The Officers of the City/Provincial Federal Government are as follows:

Section 7 The Officers of the City/Provincial Federal Commission will hold office for two (2) years and will have a maximum of two reelections.

Section 8 Duties and Functions of the Federal Officers:

A. The Federal Commission Officers and its functions:

Section 8.A.1 The Federal Commissioner – Shall be the Chief Executive of the Entire Chartered City/ Provincial Federal Government & The City/Provincial Federal Commission.

As such, He/She shall exercise supervision over the Federal Officers and see to it that its constitutional duties and obligations, national and in the local level are fulfilled.

He/She shall implement the policies and resolutions promulgated by the Federal Congress and encourage other chapters within his area confederation to work for the improvement and development of their respective chapters.

Section 8.A.2 Deputy Federal Commissioner- Shall Serve as the Presiding officer of the Federal Congress in all its sessions and meetings.

Shall see to it that all proposals and resolutions are forwarded in a span of time short enough for immediate action and implementation of the Federal Executive Officers.

Shall take over the position of the Federal Commissioner in case of vacancy.

Section 8.A.3 Federal Commissioner for Records- Shall serve as the secretary of the Federal Government and the Federal Commission. As such he/she shall be responsible for the minutes of all meetings of the Confederation and the Federal Commission and for such records as will make possible the measuring of results necessary for the General Assembly.

Section 8.A.4 Federal Commissioner for Finance – Shall serve as the Federal Treasurer of the Federal Government and the Federal Commission. As Such He/She shall He/She shall receive and hold in custody all monies received by the Federal Government from whatever source and for whatever purpose, subject to the order of the Federal Government or its Federal Commission for the disbursement thereof. All funds in the custody of the Treasurer shall be maintained in an account in a banking institution, and an accurate account under the necessary classifications or subdivisions shall be maintained. The disbursement of the funds of the Federal Government shall be made only upon approval of the Federal Commission.

Section 8.A.5 The Federal Commissioner for Finance shall report the state of the treasury at all regular meetings of the Federal Commission and general assembly of the Federal Government and at all times shall make annually a duly audited public report of all money received and disbursed, to include a statement of assets and liabilities.

Section 8.A.6 Federal Commissioner for Audit - He/She shall serve as the Auditor of the Federal Government and the Federal Commission. As such, he/she shall conduct periodic audit of books of accounts of the Area Confederation, verify and certify to the correctness of all financial transactions of the Federal Government, ascertain income intended for and accruing to the Federal Government of any and all kinds are received and properly recorded. With the Federal Commissioner for Finance, he/she shall conduct the annual or semi annual property inventory of the Federal Government.

Section 8.A.7 Federal Commissioner for Information - He/She shall be the Public information officer of the Federal Government, as such he/she shall be in-charge of disseminating all information, releases, and notices to the public, to the members, to the chapters and to other agencies that may help the organization. He/she shall also be responsible of all gathering outside data and pass it on to the Federal Commission for any use and for basis of improving the image of the organization. He/she shall serve as the PR officer of the entire Federal Government.

Section 8.A.8 Federal Commissioner for Allied Services - He/She shall be in-charge of other services not specifically included in the duties of other Federal Commissioners. He/She shall be in-charge of Elections of inferior bodies and see to it that the conduct of election is within the bounds of the CBL.

Shall also be in-charge of Special programs of the Federal Commission which may be decided by the Federal Congress and approved by the Federal Commissioner.

Shall be In-charge of the re-integration of Guardians member of other Faction and sees to it that these are all in-order before submitting for approval to the National Leadership.

Section 8.A.9 Federal Commissioner for Membership & Promotions- He/She shall be in-charge in the review of all applications for membership of the entire Federal Government.

Shall see to it that all requirements and qualifications are complied with and followed in the chapter level.

He/She reviews all recommendations for promotions and see to it that all requirements are complied with before submission to the higher authorities for approval.

Section 8.A.10 Federal Commissioner for Economic Enterprise- Shall be the Business Manager of the entire Federal Government. As such, he/she shall work for the economic development of the Federal Government and submit plans to the Federal Commission for scrutiny and approval.

He/She shall be the over-all in-charge of all economic activity of the Federal Government and may recommend disapproval of any economic activity he./she finds un applicable.

He/She also review and advise other chapters for their submitted request for economic activities and forward the same to the Federal Commission for action.

Section 8.A.11 Federal Commissioner for Security - He/She shall be the Sergeant –at-Arms of the entire Federal Government and see to it that order is observed during Assemblies, meetings and the like.

He/She shall review and or submit plans for security in all functions of the entire Federal Government.

B. Federal Congress and its functions:

Section 8.B.1 The Federal Congress is the Legislative Body of the Federal Government. As such, It will formulate policies, make resolutions and promulgate rules for the Federal Government for its development membership recruitment, community services, and economic projects not contrary to the National Policies and the this Constitution and By-Laws.

Section 8.B.2 The Federal Congress shall be composed of Eight (8) Federal Congressmen elected at large by the voting Delegates during the assembly called for the purpose, from among the nominee.

The Federal Congressmen will hold office for the period of Two(2) years subject to reelection.

Section 8.B.3 The Federal Congress shall be presided by the Deputy Federal Commissioner as head of the Federal Congress.

Section 8.B.4 A Floor Leader and a Congress Secretary shall be appointed by the Deputy Federal Commissioner from among the Federal Congressmen to serve in the Federal Congress for the period of two (2) years, except when a replacement is deemed necessary as requested by the majority of the Congressmen and or as desired by the Deputy Federal Commissioner, a new appointment is made for the unfinished term of the replaced official.

Section 8.B.5 All Policies, Resolutions, Promulgated laws shall be subject the approval of the Federal Commissioner before implementation.

C. Provincial/City Federal Fraternal Commission officers and its functions:

Section 8.C.1 The Provincial/City Federal Fraternal Commission shall be the governing body of the quasi-judicial function and fraternal activities of the Federal Government. It shall be elected by the Founders registered in the chapter within the jurisdiction of the Federal Government. The election shall be done during the Federal Government assembly as scheduled. The term of office shall be two(2) years subject to one (1) reelection.

Section 8.C.2 The Federal Fraternal Commission shall be exclusive for those founders registered in the Chapter but not serving in any other higher bodies.

Section 8.C.3 The Federal Fraternal Commission shall serve as the Grievance Committee of the Federal Government and at the same time serve as the Nomination & Election Committee of the Federal Government during the scheduled election.

Section 8 C.4 Duties of the Officers of the Federal Fraternal Commission:

1. City/Provincial Founder - Shall be the head of the Federal Fraternal Commission. As such He/She shall maintain cooperation and good working relationship among the members of the Federal Fraternal Commission. He/She shall see to it that all rules and regulation and policies promulgated by the National and or Federal Parliament as well as those promulgated by the Federal Congress shall be strictly followed through the Federal Commission. He/She shall also see to it that all cases brought to the attention of the Federal Fraternal Commission being the Federal Government’s Grievance Committee shall be dealt with accordingly with fairness and following the ethical standard.

2. The Assistant City/Provincial Founders shall serve as members of the Fraternal Commission whose duty is to assist the City/Provincial Founder in the implementation of policies as well as functioning as the Justice Tribunal.



ARTICLE XIV
The GUARDIANS MUNICIPAL/DISTRICT CHAPTER


Section 1. The members of the Municipal/District Chapter are coming from the organic personnel, such as the Philippine Army, Philippine National Police, Philippine Air force, Philippine Navy, Bureau of Fire Protection, Bureau of Jail Management and Penology, Philippine Coast Guard, Philippine Maritime Police, National Bureau of Prisons and Reservist and other branch of services that may be created, and the civilian component within the respective places/jurisdiction.

Section 2 The executive power of the Municipal/District Chapter shall be exercised by the Municipal/District Executive Body composed of the elected officers of the Chapter; the legislative power by the Municipal/District Legislative Council; and the quasi-judicial power by the Municipal/District Fraternal Commission.

The Municipal/District Chapter Shall be Under the Area of Jurisdiction of the established Federal Government as declared by the Parliament.

Section 3 Composition of the District/Municipal Chapter:

A. District/Municipal Executive Body elected at large by the general
Membership of the Chapter:

2. Vice President
3. Secretary
4. Treasurer
5. Auditor
6. Business Manager
7. Public Information Officer
8. Sgt. – at – Arms

B. District/Municipal Legislative Council

1. Vice President – Presiding Officer
2. 13 Councilors – elected at large by the Chapter general membership
3. Council Floor Leader appointed by the Vice President from among the 13 Councilors
4. Council Secretary appointed by the Vice President from among the 13 councilors
5. All incumbent Barangay Chapter Presidents if there are any

C. District/Municipal Fraternal Commission composed of all Founders of
The Chapter of which officers are elected from among the active Founders of the chapter headed by the District/Municipal Founder.

1 District or Municipal Founder
14 Assistant District or Municipal Founders.

Section 4 The chartering of a District/Municipal chapter shall be the authority of the Prime Minister thru the recommendation of the Minister of membership and promotions but should be passing through channel from the Chartered City/Provincial Federal Government. The charter can be revoked anytime by the Prime Minister in any case that rules and regulations and the agreement of chartering is violated.

Section 5 The District./Municipal Chapter as assigned in the corresponding committee and chapter officers, shall be responsible in the recruitment and screening of incoming members of the organization including the collection of necessary fees and dues and the remittance of the respective shares as embodied in the Constitution and By-Laws, and the Provisions promulgated by the Federal Congress. Recruitment and Recruitment Process however, shall start only after the Chapter President informed the Confederation Office Through channel of the scheduled Recruitment.

The Municipal/District Chapter shall implement all national, and Federal Government policies, rules and regulations and all other resolutions in-acted by the chapter Council.

Section 6 The District/Municipal chapter shall have legislative power through its District/Municipal council and can in-act, formulate and pass resolutions and policies not contrary with this Constitution and By-Laws.


Section 7 No member shall be elected to any position in the Executive or Chapter Council if his rank is below RMG/Supreme Godfather – Supreme Godmother in the time of election and or nomination. In cases of un availability of Ranking members, those in the membership rank can be elected on acting capacities until they qualify for promotion.

Section 8. Duties and Functions of the Executive, Legislative and quasi-Judicial Branches in the District/ Municipal Chapter

A. EXECUTIVE

1. President

a. He/She is the Chief Executive at his level of the Association;
b. Presides in all assemblies of the Association at his level;
c. Represent the association in all social functions;
d. Appoint, supervise and have control over all elected and appointed officers and members of the Association under his area of jurisdiction;
e. Direct the overall activities of the Association in close coordination with the different Barangay Chapter Presidents.
2. Vice President

a. He shall perform the duties of the President during the absence or incapacity of the latter;
b. Acts Presiding Officer in the Legislative Council.

3. Secretary

a. He shall keep a complete record or lists of all members and maintain a correct record of all the minutes of the meetings of the Association;
b. He shall give notice to all meetings called;
c. He shall take care and facilitated all communications addressed to the Association;
d. He shall turn over all books and other properties in his possession to his successor.

4. Treasurer

a. He shall be the custodian of all the funds and properties of the Association;
b. HE shall keep the financial records and transactions of the Association;
c. He shall sign and countersigned by the President on disbursement of funds of the Association;
d. He shall submit an annual report of Assets and Liabilities, which will be presented during the annual general assembly.

5. Auditor

a. He shall audit and monitor the funds of the Association from time to time;
b. He shall certify the financial reports that may be submitted to the Association;
c. He shall advice the President on the financial condition of the Association and recommend cost-saving measures;
d. He shall conduct an audit in accordance with the rules and procedures in auditing on or before the 31st of January of each year.

6. Business Manager

a. He shall formulate economic plans and strategies to improve the financial condition of the Association;
b. He shall submit for approval by the Council a feasibility study of any business ventures;
c. He/She manages any business venture of the Association.

7. Public Information Officer

a. He shall be the official spokesman of the Association;
b. He shall be responsible for the image building of the Association;
c. He shall screen all press and media releases;
d. He shall submit for approval by the Council any major policy in making reports to the media.

B. LEGISLATIVE ( Chapter Council)

1. Councilors – The Councilors as a body shall have the following functions, powers and authority;

c. To authorize the President to receive donations, enter into contracts and engage in fund raising activities;
d. To levy fees and/or assessments;
e. To make provisions for accident fund, mortuary fund, and other miscellaneous funds, initially at the District/Municipal chapter;
f. To regulate the recruitment of members except Founders prescribing the requirements and procedures for screening and interview only;
g. To adopt policies and procedures on transfer of membership, change of status, treatment of suspended, expelled and inactive members;
h. To promote the well-being and periodic assessment of the actual membership of the Association;
i. To undertake sports and other professional advancement activities;
j. In case of vacancy, to call for Special Assembly to elect and fill up the vacancy of the Council;
k. To make representations with concerned government agencies and non government organizations related to peace and prosperity; and

l. To perform such other duties as may be required, or exercise each other rights or authority as may be granted by the Association in a duly convened Assembly.

2. The Officers of the Chapter Council who shall be elected from among the elected Chapter Councilors shall be as follows:

One (1) - Council Floor Leader
One (1) - Council Secretary

3. The Council Floor Leader shall be responsible in the preparation of the Sessions Agenda as well as the schedule of Priority items to be discussed by the Council.

4. The Council Secretary Shall be responsible in the recording and keeping of the minutes of the session, keeping of the resolutions, all Council documents and shall be made available for scrutiny and or for referrals.

C. DISTRICT FRATERNAL COMMISSION

a. District/Municipal Founder

1. He/She shall be the over-all supervisor of the Commission within the District/Municipality.
2. Shall have the authority to approve or disapprove membership of new applicants and promotion of members as endorsed by the Chapter President through a Council resolution.
3. Shall serve as the final arbiter or judge of all conflicts or grievances by chapter members and other officers of the chapter upon consultation of other District/Municipal founders
4. He/She shall have a very close coordination with the Chapter President and the Vice President to ensure success of the association
5. Shall submit annual report to the Chartered City/Provincial Federal Fraternal Commission on all matters that affects the chapter
6. Shall directly report to the Chartered City/Provincial Federal Fraternal Commission
7. Perform all other functions as maybe promulgated by the Federal Government from time to time

b. Assistant District/Municipal Founders


Shall assist the District/Municipal Founder on matters pertaining administration and judicial administration of the Chapter.
i. Shall supervise the Assistant District/Municipal Founders for Election, Appointment, Finance, Audit, Information and External Coordination
ii. Shall perform all other functions as maybe assigned to them from time to time

ARTICLE XV
The BARANGAY CHAPTER

Section 1 The Barangay Chapter is the smallest unit of the Association.

Section 2 It shall composed of members within the Barangay and shall only form and exist if permitted by the District/Municipal Chapter.

Section 3 The Barangay Chapter shall have no Legislative authority but purely Executive and shall be under the supervision of the District/Municipal Chapter.


Section 4 The Officers of the the Barangay Chapter shall be as follows:

1. President
2. Vice President
3. Secretary
4. Treasurer
5. Auditor
6. Business Manager
7. Public Information Officer
8. Sgt. At Arms

Section 5. Duties of the Officers of the Barangay Chapter:

A. Chapter President

1. He/She will be the Chief Executive of the Chapter
2. Presides over all assemblies & meetings of the Chapter
3. Represent the association in all functions
4. He/She serves as member of the Municipal/District Council in his capacity as Chapter president of the Barangay chapter
5. Direct the overall activities of the association under his chapter

B. Vice President

1. He/She shall perform the duties of the President in case of his absence
2. He/She serves as the Chairman of the Membership & Promotion Committee of the Barangay chapter
3. Perform all other functions as maybe assigned to him from time to time.




C. Secretary

1. He/She shall keep a complete record or list of all members and maintain a correct record of all minutes of the meeting of the chapter.
2. He/She shall give notice to all meetings called
3. He/She perform all other functions as assigned to him from time to time.

D. Treasurer

1. He/She shall be the custodian of all funds and properties of the organization and as such shall only release/disburse funds in accordance with the policies of the association.
2. He/She shall give duly audited financial report to the members on a monthly basis.
3. Shall perform all other functions as maybe assigned to him from time to time

E. Auditor

1. He/She shall served as the fund controller of the chapter, as such he/she shall see to it that disbursement of funds shall be in accordance with the generally accepted accounting procedure as embodied in the policies of the association.
2. He/She shall conduct audit, periodic or regular to ensure that the funds of the association is maintained
3. He/She shall advise the Chapter President and the Treasurer on matters pertaining funding of the association
4. Perform such other functions as assigned to him from time to time.

F. Business Manager

1. He/She shall formulate plans that will help the association raise funds for its programs and projects.
2. He serves as the social officer of the barangay chapter
3. He/She shall perform all other functions assigned to him/her from time to time

G. Public Information Officer

1. He/She shall be the spokesman of the Chapter. As such he/she shall see to it that the chapter shall gain positive publicity
2. He/She shall serve as the Liaison officer and shall see to it that all information intended to the members and other related groups or individuals are properly disseminated.
3. Shall perform all other duties assigned to him/her from time to time

F. Sergeant At Arms

1. He/She shall served as the peace officer of the association, as such he/she shall see to it that order shall at all times be observed in all gatherings and proceedings of the association.
2. He/she shall coordinate with other officers in the implementation of such order and shall be knowledgeable of the rules and regulation that governs the association.
3. Shall perform all other functions as assigned to him/her from time to time





ARTICLE XVI
NOMINATION AND ELECTION

Section 1 The four non – expiring members of the Council of Elders shall be responsible in the conduct of Election in the National Level. They convene themselves as National Election & Nomination Committee and conduct the election.

Section 2 The National Election & Nomination Committee will supervise and or conduct the Election of the Following:

A. Selection and Election of the expiring members of the Council of Elders, the positions National Executive Department, Members of the Guardians Parliament, National Fraternal Council and elective Officers of the Federal Confederations

Section 5 The election shall be conducted during the last day of the National Convention which is scheduled every after Two (2) years as determined by the delegates of the convention who shall ratify this Constitution and By Laws.

Section 6 The Election of officers of the National Parliament shall be done right after the election of the Parliament.

Section 7 The Election of the different Federal Government Officials shall be done every first Saturday of March every two (2) years.

Section 8 The Election of Chapter Officers shall be done every First Saturday of December every two (2) years.

Section 9 With the exception of those otherwise provided for herein, all election to be conducted shall in secret balloting.

ARTICLE XVII
MEETING, NOTICE, QUORUM, AND OTHER RELATED MATTERS

Section 1 The Meeting, sessions, general assemblies of the different sets and
category of the officers as well as members shall de decided by the responsible Bodies themselves and shall be approved by the higher authorities.

Section 2 All Chapter officers shall regularly meet in their respective categories ones a month and the Chapter General assembly of the membership shall be scheduled ones every Two months.

Section 3 Attendance of all members in case of a Chapter assembly is required and all officers in their category is required in all meetings and sessions. However, for the purpose of having quorum to approve all concerns, the equivalent attendee shall be 50% to constitute a quorum.

Section 4 In cases of National Assembly and Conventions, Each Chapter shall be entitled to a Maximum of Five (5) voting delegates, regardless of rank, selected by the Chapter. The delegates shall be headed by the Chapter President. The Founders however are separately counted as voting delegates. All elected and appointed officers in the Central Government and the Federal Confederations and Federal Government whose terms of office is considered incumbent are counted as official voting delegates.

All other members regardless of rank may attend the National Conventions and Assemblies and can participate in the deliberation but without voting rights.

Section 5 In the Case of the Federal Government, each chapter is entitled to have a maximum of Five (5) voting delegates with the rank of MG or RMG headed by the Chapter President to elect the different officers of the Federal Government in a scheduled Federal Government General Assembly called as scheduled. All Founders registered in the Chartered Chapter are considered official voting delegates. Other participants may also attend but without voting rights.

Section 6 All procedure shall be observed following the Roberts Rule

ARTICLE XVIII
COMMITTEE

Section 1 There shall be Standing and Special Committees which shall be created and or organized by the different governing bodies which will help in the organizations operations and functions.

Section 2 The Different Governing bodies at all levels except those explicitly discussed in the Constitution and By Laws may have the authority to name, create, and or organized their own committees with membership exclusively coming from its area of jurisdiction.



ARTICLE XIX
FUNDS

Section 1. The funds of the Association shall be derived from membership fees, monthly dues, annual chapter dues and special assessments of members, grants, donations or benefits.

Section 2 National Funds shall be held in custody by the Minister of Finance who is serving as National Treasurer of the entire organization.

Section 3 All funds remitted and received by the National Organization shall be coursed through the Minister of Finance and corresponding official receipts shall be issued to the payee or the remitting person(s), Officer(s) and or Body as a proof of receipt and shall be deposited immediately to the official depository bank for safekeeping.

Section 4 No collection shall be made except those stated in this By Laws or those with prior approval of the Prime Minister as recommended and passed by the Parliament for the National Level, Federal Parliament for the Federal Confederations, Chartered City/Provincial Federal Congress in the Federal Government Level and the Municipal/District President as recommended and passed by the Municipal/District Council. In the Chapter level.

Section 5 Recognized chapters shall be assessed an amount of One thousand pesos(P1,000.00) as annual dues to be remitted directly to the Federal Minister of finance under its territorial jurisdiction. The Federal Confederations shall remit to the Central Government through the Minister of Finance an Annual Federal Confederations Dues in the amount of Five Thousand Pesos (P5,000.00) . This annual due shall be the basis in identifying the status of the Confederations and the chapter. Confederations and Chapter failing to remit annual dues shall not be granted the active status and shall forfeit all benefits and privileges granted to all members including the issuance of National Identification Cards.

Section 6 The other Federal funds shall be decided and determined by the Federal Confederation and the Government of their respective jurisdiction.

Section 7 The Federal Confederations and Federal Government may implement fees and dues as decided by the Federal Parliament and or Federal Congress and shall be based on the economic status of the general membership and economic standing of the Federal Jurisdiction.

Section 8 All Resolutions and rules shall not be contrary to the General Provision of this CBL and shall conform with the Resolution and rules as promulgated by the different Parliament.

Section 9. The amount for the monthly due of the members in the chapters shall be determined by the Federal Confederation and the Federal Government. The Chapter annual dues to be remitted by the chapters to the Federal Confederation and the Federal Government shall be determined by the Federal Parliament and Federal Congress.

Section 10 National Identification card Fee and Certificate of National Membership of whose amount shall be determined by the Federal Confederations, shall all be remitted to the Federal Minister of Finance and issuance of Identification Cards and certificate of membership shall be done not later than 30 days upon remittance of payments together with the 3rd copy of the membership application forms and application for identification cards complete with all the requirements duly approved by the corresponding officials.

Section 11 Other assessment is distributed as follows:

Section 12 In cases of Areas with Barangay Chapters, fifty percent (50%) of the monthly dues shall be retained by the Barangay Chapter. All other fees and dues collected shall be taken cared of by the mother chapter with close coordination with the Barangay Chapter.

Section 13 Promotions assessment for those members who will be promoted shall be remitted directly to the Minister of Finance with the following classification:
1. From GDN to GF/GM/SGF/SGM - P300.00
2. From MG to RMG - - P300.00
3. From GF/GM/SGF/SGM to Founder (F)P500.00
4. From RMG to Founder (F) - - P500.00
5. From Founder to National Founder (NF) P1,000.00
6. From National Founder (NF) to Master Founder ( MF)
- P1,500.00

Section 14 All fees collected by the chapter shall be coursed through the Chapter Treasurer and no other member and or officer shall be allowed to make collections except when explicitly authorized by the body through Chapter Council resolution approved by the chapter President.

Section 15. Municipal/District/Branagay Chapter Fees and Dues for every new member before acceptance and markings:

The succeeding monthly dues shall be paid every anniversary date of his membership.

Section 16 Disbursement/ Withdrawal from the funds of the Association in the Chapter level, whether by check or any other instrument, shall be signed by the Chapter Treasurer countersigned by the Chapter President with prior verification of the Chapter Auditor. Only Disbursement as approved by the Council shall be considered authorized.:

Disbursement/withdrawal from the Federal Funds shall be following the financial policies of the Federal Government promulgated by the Federal Legislative Bodies.

Section 17 Disbursement/Withdrawal of National funds shall be signed by the Minister of Finance and countersigned by the Prime Minister, or in his absence, the Senior Deputy Prime Minister, with prior verification of the Minister for Audit. Disbursement shall be based on the annual budget as approved by the National Parliament.

In cases of disbursement not within the annual budget, a Parliament resolution and approval is deemed necessary.

Section 18 All Funds collected and or remitted to the Minister of finance shall be form part of the Funds of the National organization. A Financial Report which specifically states all receipts and disbursements prepared by the Minister of Finance duly audited by the Minister of Audit and approved by the Prime Minister shall be submitted and distributed to the four (4) Federal Confederations and will make available to all City/Provincial Federal Government as well as the Chapters of the Organization on a quarterly basis.

Funds collected or remitted to the Federal Confederations Minister of Finance shall be the funds of the Federal Confederations and shall be subject to Federal Confederations receipt and disbursement rules.

An audited Financial Statement shall be prepared annually and shall be reported to the General Assembly which will be held as scheduled.

Section 19 Chartered City/Provincial Federal Government, District/Municipal chapters and the Barangay chapters shall prepare a monthly Financial Report of all receipts and disbursements of funds in their respective Bodies, shall render report to the Members under their jurisdiction. The Financial report shall be prepared by the City/Provincial Federal Commissioner for Finance for Chartered City/Provincial Federal Government, Chapter Treasurer for the Chapters, duly audited by their respective Auditors and approved by their respective head s( City/Provincial Federal Commissioner or Chapter Presidents)

An Annual Financial Report Shall be submitted to the National Office Through the Minister of Finance every end of the Fiscal Year.

Section 20. The fiscal year of the Association shall be from January 1st to December 31st of each year.

ARTICLE XX
DISCIPLINARY SCHEME

Section 1 Any member or officer whose conduct or activities are contrary to the By-Laws, rules and regulations of the Association shall be subjected to disciplinary action.

All complaints and or cases shall be filed to the following for immediate resolution and or settlement:

For Barangay Chapter – to the Municipal/District Fraternal Commission

For the Federal Government – to the Federal Fraternal Commission

For the Federal Confederations- to the Federal Fraternal Commission

For the National level - to the National Fraternal Council


Section 2 Any member maybe suspended or expelled under any of the following grounds:

1. Non- Payment of membership fee, annual or monthly dues and other assessment for three (3) consecutive months;
2. Non payment of fines properly imposed upon him/her;
3. Failure despite notice, to attend without sufficient cause as maybe determined by the concerned officer for three (3) consecutive meetings of the association;

4. Other infractions or violations of the Constitution & By Laws, rules and regulations of the association, after final determination thereof by the Disciplinary officers of the association.

Section 3 Immediate expulsion and or filing of appropriate charges in the Proper Court of the Philippines and or any other legal bodies shall immediately be meted upon, after final judgment of guilt by the National Fraternal Council on members or officers committing grave and serious offense as:

1. “Unauthorized collection of fees, monthly dues, promotion dues, membership fees, lecturers fee and other fees, and, disbursement of the same without authority and or giving of authority to do the same for persons not authorized for such actions, and unauthorized manufacture of Identification Cards, Certificates of National Membership and Official Guardians National Supplies such as National T-Shirts, National Sweat Shirts and National Vest.”

2. “ Unauthorized recruitment and membership processing, including the conduct of initiations without prior approval of the Chartered Chapter within the territorial area of the said chapter, and without permission from the authorized National Bodies course through the Federal Commissioner for Membership & Promotions.”

3. “Unauthorized conferment of promotions including markings without passing through the proper bodies and approval of the National Promotion Board.”

Section 4 The following are other grounds or causes for disciplinary action:

1. Neglect of duty
2. Irregularity in the performance of duty
3. Misconduct
4. Incompetent
5. Oppression
6. Dishonesty
7. Disloyalty to the association
8. Violation of law as determined by regular courts

Section 5 The following penalties may be imposed upon any erring member or officer:

1. Removal & filing of appropriate charges in the proper courts - for serious and grave offense
2. Suspension- for less serious and less grave offense
3. Fine/Admonition/Warning - for light offenses

Section 6 Any complaint against any member or officer shall be made in writing and verified under oath before an officer authorized to administer oath and properly filed pursuant to section1 hereof.

Section 7 The implementing guidelines for the procedures in the investigation and disposition of administrative complaint against officers and members shall be promulgated by the Guardians Parliament.


ARTICLE XX1
TRANSITORY PROVISION

Section 1 The Council of Elders shall be given the authority to make appointments on all National Positions for the purpose of the implementation of the Constitution and By Laws. The appointment however shall only be valid up to the scheduled election which shall be called on August 2010 of which term of office shall be up to May of 2011.









The regular schedule of elections shall be every National Assembly which is scheduled every two (2) years after May of 2011.

Section 4 All other Governing Bodies shall elect their officers following the provisions of the Constitution and By Laws.



ARTICLE XXII
AMENDMENTS/REPEAL


Section 1 Amendments, Modifications, Repeal to this Constitution and By-Laws maybe proposed in writing by at least One Hundred five (105) members of the association, furnishing copies thereof to each member of the Federal Confederation Parliament who shall consider such proposed amendment/repeal within thirty (30) days upon receipt thereof. Such proposed amendment or repeal shall state hereon the old provisions and the proposed new provisions. Amendments/repeal to this Constitution and By-Laws, shall be approved by two thirds vote of all voting delegates present during the National Assembly/National Convention called for the purpose.

For the purpose of implementation of this Constitution and By Laws, amendments shall only be considered not earlier than May 2015.




ARTICLE XX1II
RATIFICATION/CONFIRMATION OF ACTS


Section 1 All acts, things, deeds, contracts, papers, agreement, disbursements and other actions that have been made, executed and signed, do and performed previously which are necessary and requisite to be done in and about the premises are hereby ratified and confirmed to have been done or cause to be done by virtue thereof.



ARTICLE XXIV
EFFECTIVITY

Section 1 This Constitution and By-Laws shall take effect upon its approval, ratification and adoption by the majority of all delegates/participants to Special Assembly scheduled on ________________ at Iligan City, Mindanao, Philippines.
